AN ORDINANCE TO INITIATE AN AMENDMENT TO ARTICLE VI OF THE HAWAI‘I COUNTY CHARTER (2020 EDITION), BY ADDING A NEW CHAPTER TO ESTABLISH A DEPARTMENT OF BUILDING.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I:
SECTION 1. Purpose. The Building Division is one of six divisions currently located in the Department of Public Works. This Charter Amendment proposes to move certain Building Division
functions that do not pertain to County assets into the new Department of Building to be led by an individual with professional experience in the building and development trades.
SECTION 2. Article VI of the Hawaiʻi County Charter (2020 Edition), is amended by adding a new chapter to be appropriately numbered and to read as follows:
“CHAPTER ____
DEPARTMENT OF BUILDING
Section _______. Organization.
There shall be a department of building consisting of a director and the necessary staff to carry out permitting, inspection, and code enforcement.
Section _______. Director.
The director of the department of building shall be appointed by the mayor, confirmed by council, and may be removed by the mayor. The director shall have a minimum of five years of
administrative experience in the building or development trades.
Section _______. Powers, Duties, and Functions.
The department of building shall:
Manage plans, specifications and applications for private building and construction;
Be responsible for the issuance of all plumbing, electrical and building permits;
Enforce all county ordinances related to building, construction and inspection;
Process sign applications and variances; and
Exercise other functions as prescribed by the mayor or prescribed by ordinance.
SECTION 3. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions
or applications of the ordinance, which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable.
SECTION 4. Upon adoption of this ordinance, this Council, by appropriate resolution, shall provide that this amendment be submitted to the electorate of Hawai‘i County for approval
in the 2022 general election.
SECTION 5. Upon approval of the charter amendment proposed in this ordinance by a majority of voters voting on this legislation in the 2022 general election, as duly certified, this
ordinance shall take effect on July 1, 2023.
