SOLUTION NO. 47 6 22
RESOLUTIONAUTHORIZING THE PAYMENT OF FUNDS FROM THE
APPROPRIATIONS OF A LATER FISCAL YEAR FOR A LEASE OF REAL
PROPERTY FOR THE COUNTY OF HAWAII MASS TRANSIT AGENCY
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other
obligation requiring payment of funds from the appropriations of a later fiscal year or of more than one
fiscal year be approved by resolution; and
WHEREAS, the Mass Transit Agency desires to lease a commercial space situated at Kings'
Shops, Waikoloa, Hawaii 96738, from KS Owner, LLC ("Landlord"); and
WHEREAS, this space will allow for the parking of up to ten(10) buses and provide a
breakroom and rest area for Hele-On bus operators; and
WHEREAS, the Mass Transit Agency desires to enter into a lease agreement that is
anticipated to commence on September 1, 2022, for twelve (12) months with the option to extend the
lease for an additional one (1)year with Landlord; and
WHEREAS, the Mass Transit Agency is requesting authorization for the Mayor to enter into a
lease agreement with payments of funds from the appropriations of a later fiscal year; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that pursuant
to section 10-11 of the Hawaii County Charter, the Mayor is hereby authorized to enter into a lease
agreement with KS Owner, LLC for one (1)year with options as indicated above for the Mass Transit
Agency.
BE IT FURTHER RESOLVED that sufficient funds be budgeted in future fiscal years to
cover the anticipated obligations of the County under the terms of the Lease.
BE IT FINALLY RESOLVED that County Clerk shall transmit a copy of this resolution to:
(1) Mayor Mitchell D. Roth; (2) Department of Finance; and (3) Mass Transit Agency.
