RESOLUTION NO. 478
RESOLUTION AUTHORIZING THE TEMPORARY CLOSURE OF THE SOUTHERN
ROADWAY STUB-OUT OF KA`EKA STREET IN THE DISTRICT OF NORTH KONA,
COUNTY AND STATE OF HAWAII.
WHEREAS, pursuant to Section 24-153.3, Subsection(b) of the Hawaii County Code
1983 (2016 Edition, as amended), "the Council by resolution, in consultation with the chief of
police and the director of public works, may authorize the temporary closure of a roadway stub-
out, dead-end and/or road terminus...", subject to certain conditions; and
WHEREAS, Ka`eka Street is a County road that extends north and south from
Manawalea Street in the district of North Kona, County and State of Hawaii, and is depicted and
attached hereto as Exhibit"A"; and
WHEREAS, residents of Lei Kupuna and Lei `Ghana at Kamakana Villages have
complained that the roadway stub-out at the south end of Ka`eka Street provides unlimited
access to convenient and unrestricted areas for activities that compromise public safety,
including loitering, littering, consumption of alcohol, and other illegal activities; and
WHEREAS, closure of the southern roadway stub-out of Ka`eka Street would not affect
the flow of traffic or public access, and adjacent landowners are in support of the same and have
been provided with written notification regarding the purpose and need for this temporary
closure, which notification letter is attached hereto as Exhibit`B"; and
WHEREAS, the Chief of Police and the Department of Public Works have been notified
and have expressed approval of the temporary closure of the southern roadway stub-out of
Ka`eka Street, which notification letter is attached hereto as Exhibit"C"; and
WHEREAS, in order to reduce acts of loitering, littering, and illegal consumption of
alcohol, and to promote a safer and cleaner community that can be fully enjoyed and embraced
by its residents, the County Council finds that the southern roadway stub-out of Ka`eka Street
should be temporarily closed and barricaded; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that
pursuant to Section 24-153.3 of the Hawai`i County Code,the southern roadway stub-out of
Ka`eka Street shall be closed and barricaded until such time as the council, by resolution,
authorizes its reopening.
BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this
resolution to the Honorable Mitchell D. Roth, Mayor, the Chief of the Hawai`i Police
Department, and the Director of the Department of Public Works.

Hawaii County Real Property Tax records indicate that you are the owner of real property
adjacent to Ka`eka Street in North Kona.
On behalf of constituents of the Lei Ki5puna and Lei `Ohana at Kamakana Villages in North
Kona,I am part of a comprehensive effort to reduce illegal behavior such as loitering, littering,illegal
consumption of alcohol,in order to promote a safer and cleaner area on and around Ka`eka Street.
I have prepared a resolution pursuant to County Code Section 24-153.3, for introduction at
Council to assist our efforts,which resolution would authorize the temporary closure and barricade of the
southern roadway stub-out of Ka`eka Street,
