HomeMy WebLinkAboutRES 493 Draft 01 2020-2022A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH THE UNITED STATES OF AMERICA DEPARTMENT OF TRANSPORTATION FEDERAL AVIATION ADMINISTRATION REGARDING
WEATHER CAMERAS AND INSTRUMENTS TO BE MOUNTED ON COUNTY OF HAWAIʻI’S TOWER.
WHEREAS, Hawaiʻi Revised Statutes Section 46-7 requires that County departments obtain the consent of the Council to enter into agreements with the federal or state governments respecting
action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant
to those powers; and
WHEREAS, the County of Hawai‘i owns an existing open-frame tower located at 19-50-08.0 N 155-06-33.0 W; 28-2892 Alia Street, Pepe‘ekeo, HI 96783; and
WHEREAS, the United States of America Department of Transportation Federal Aviation Administration (“FAA”) would like to mount four (4) aviation weather cameras and a small weather instrument
on said tower; and
WHEREAS, the FAA will also have a camera control unit installed inside the communications shelter; and
WHEREAS, the FAA and the County of Hawaiʻi desire to enter into a Federal Aviation Administration Lease for Real Property effective June 1, 2022 through May 31, 2037; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that in accordance with Hawaiʻi Revised Statutes Section 46-7, that the Mayor of the County of Hawaiʻi is authorized to execute,
on behalf of the County, an intergovernmental agreement with the FAA
regarding said tower.
BE IT FURTHER RESOLVED that the intergovernmental agreement (Federal Aviation Administration Lease for Real Property) with the FAA is hereby consented to and approved.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the Director of Finance, Civil Defense Administrator, Mayor Mitchell D. Roth, and Dakota Frenz,
Deputy Corporation Counsel.
