RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A MULTI-YEAR AGREEMENT WITH SPECIAL COUNSEL FOR LEGAL AND PROFESSIONAL SERVICES
COVERING WORKERS’ COMPENSATION MATTERS.
WHEREAS, pursuant to Section 10-11 of the Hawai‘i County Charter (“Charter”) requires that any contract, lease or other obligation requiring payment of funds from the appropriations
of a later fiscal year or of more than one fiscal year be approved by resolution; and
WHEREAS, pursuant to Section 6-5.5 of the Charter, the Office of the Corporation Counsel (“Corporation Counsel”) wishes to enter into a multi-year agreement with Leong Kunihiro Brooke
& Kim, which Leong Kunihiro Brooke & Kim will provide legal professional services for all of the Corporation Counsel’s workers’ compensation matters; and
WHEREAS, Leong Kunihiro Brooke & Kim was duly selected in compliance with the procurement of professional services under Chapter 103D-304, Hawai‘i Revised Statutes, as amended; and
WHEREAS, the agreement is anticipated for a period of three (3) years, commencing on or about October 1, 2022; now therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that:
That the Mayor is hereby authorized to enter into a three (3) year agreement with Leong Kunihiro Brooke & Kim for the legal professional services as described above.
That sufficient funds be budgeted in future fiscal years to cover the anticipated obligations of the County under the terms of the agreement.
BE IT FINALLY RESOLVED that the County Clerk of the County of Hawai‘i shall transmit copies of this resolution to the Office of the Mayor, the Department of Finance, the Office of the
Corporation Counsel and the Department of Human Resources.
