HomeMy WebLinkAboutRES 564 Draft 01 2020-2022A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A MULTI-YEAR LICENSE AGREEMENT WITH THE TRUSTEES OF THE ESTATE OF BERNICE PAUAHI
BISHOP FOR THE ENTRY AND USE OF A PORTION OF TMK (3) 9-3-001-006 FOR THE SOUTH POINT TOWER.
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other obligation requiring payment of funds from the appropriations of a later fiscal year or of more
than one fiscal year be approved by resolution; and
WHEREAS, the Trustees of the Estate of Bernice Pauahi Bishop (“Licensor”) owns TMK (3) 9-3-001-006 (“Subject Parcel”); and
WHEREAS, on the Subject Parcel there is a non-manned facility, which includes an 80 ft. tower (“South Point Tower”), antennae improvements, equipment shelter, generator, propane tank
and fencing; and
WHEREAS, Civil Defense desires to enter into the license agreement to operate and maintain the South Point Tower for an annual license fee of five thousand dollars ($5,000) plus GET;
and
WHEREAS, Civil Defense is requesting authorization for the Mayor to enter into a multi-year license agreement with Licensor for the Subject Parcel; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that the Honorable Mitchell Roth, Mayor of the County of Hawai‘i, is hereby authorized to enter into a multi-year license agreement
with Licensor, for a five (5) year period commencing March 1, 2022, and extending through and ending February 28, 2027.
BE IT FURTHER RESOLVED that sufficient funds be budgeted in future fiscal years to cover the anticipated obligations of the County under the terms of this license agreement.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the Director of Finance, Civil Defense Administrator, Mayor Mitchell D. Roth, Dakota Frenz,
Deputy Corporation Counsel, and the Trustees of the Estate of Bernice Pauahi Bishop, 567 South King Street, Suite 200, Honolulu, HI 96813.
