SUBJECT: Draft Ordinance Amending Chapter 14, General Welfare, Chapter 22, Streets and
Sidewalks and Chapter 24, Vehicles and Traffic of the Hawaii County Code
Forwarded for your consideration is a drafr ordinance that moves provisions established by Ordinance 98-135
relating to "Coasters, Roller Skates, Roller Blades, Skateboards and Similar Devices" out of Chapter 22 and into
Chapter 24, Article 1, Section 24-4. Similarly it also moves the provisions established by Ordinance 99-1 relating
to "Soliciting for Money or Objects of Value" out of Chapter 22 and into Chapter 14 as a new article.
W e have recently completed a draft ord finance for Chapter 22 that focuses on construction, maintenance and other
related activities that affect our responsibility and ability to maintain the functionality and safety of county
streets. As a result, Ordinance 98-135 and 99-1 will not be compatible with our proposed changes to Chapter
22. To reduce confusion, we would like to move these ordinance provisions before the submission of our draft
for Chapter 22.
Chapter 24, Article 1, Section 24-4 already addresses use of coaster, roller skates and similar devices within a
street. Except for its penalty section, Ordinance 98-135 is being added to 24-4 as new item. We removed the
penalty provisions to maintain consistency with Chapter 24. AstoOrdinance99-l, becauseitregulatessoliciting
of money over a variety of locations, including private residences, properties and bu ildings, we feel its provisions
will be appropriate within Chapter 14, General Welfare.
