Subject: Amendment to Declaration of Covenants

Upon review of your declaration of covenants for the above-referenced change of zone ordinance,
the Office of Corporation Counsel has determined that the applicant has not complied with
Condition E, which prohibits the construction of a second dwelling unit on the lots. Specifically,
the Corporation Counsel requests the applicant amend the definition of "dwelling" in the
Declaration. Attached is a copy of the Corporation Counsel's memo for your reference.
Due to the above, Final Subdivision Approval will be granted upon compliance with all conditions
of the ordinance, including the submission of a copy of the revised covenant to this office for
review and approval, as stated in Condition E. A copy of the approved covenant(s) shall be
recited in an instrument executed by the applicants and the County and recorded with the Bureau
of Conveyances prior to Final Subdivision Approval.
