Your Committee on Planning, to which was referred Resolution No. 576-22,reports as follows:
Resolution No. 576-22, transmitted by Planning Director Zendo Kern, via Communication No. 1037,
dated September 28, 2022, accepts a grant of public access and preservation easement from Kuleana
Spirits, Inc. The subject parcel is on Tax Map Key: 5-5-006:010. The project area is approximately
43.854 acres. Resolution No. 576-22 was introduced by Chair Ashley Kierkiewicz, by request.
Deputy Corporation Counsel Jean Campbell appeared before Your Committee in the Hilo
Chambers to represent the Planning Department. She explained that this property is across from
the property adjacent to the Upolu Airport Road in North Kohala. The requirement for the public
access easement was established in 2002 after a settlement agreement.
In 2018, the access easement was expanded to include a preservation element with the approval
of a Special Management Area(SMA)use permit. The SMA use permit had a provision to
provide pedestrian and vehicular traffic public access that is compliant with the historic
preservation requirements from the State Historic Preservation Division preservation plan.
The vote was then taken on the motion to move this measure to Council with a favorable
recommendation and passed with eight"ayes," Committee Member Tim Richards absent.
Your Committee on Planning is in accord with the purpose and intent of Resolution No. 576-22,
and recommends its adoption.
