AN ORDINANCE AMENDING CHAPTER 15, ARTICLE 4, SECTION
15-39, OF THE HAWAI‘I COUNTY CODE 1983 (2016 EDITION, AS AMENDED), RELATING TO CAMPING AND TRAILER AREAS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I:
SECTION 1. Chapter 15, article 4, section 15-39 of the Hawai‘i County Code 1983 (2016 Edition, as amended) is amended to read as follows:
“Section 15-39. Camping and recreational vehicle or other camping units [trailer] areas.
(a) Camping [and the use of trailers or other camper units are] is only permitted as follows:
(1) At Laupāhoehoe Beach Park, Kolekole Beach Park, [Isaac Hale Memorial Park,] Isaac Kepoʻokalani Hale Beach Park, Punalu‘u Black Sand Beach Park, Whittington Beach Park, Miloli‘i Beach
Park, Ho‘okena Beach Park, Mahukona Beach Park, Kapaʻa Beach Park, and [Samuel Spencer Beach Park,] Spencer Park at ‘Ōhai‘ula Beach [the use of trailers or other camper units are permitted
on any suitable place other than picnic or lawn areas]. The camper shall give due regard to the rights and convenience of other users of the park, shall not obstruct any roadway or
pathway, and shall not monopolize any facility intended for the use of all users of the park.
(2) At [Samuel Spencer Beach Park,] Spencer Park at ‘Ōhai‘ula Beach, camping is permitted in two camping areas known as areas “A” and “B.” Area “A” is mauka of the large pavilion between
the Hapuna boundary of the park and the outdoor courts. Area “B” is between the north side restroom and the central restroom.
(b) Use of recreational vehicles or other camper units are only permitted at Whittington Beach Park and Spencer Park at ‘Ōhai‘ula Beach in stalls that have been approved by the director
and clearly designated for such use.”
SECTION 2. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material, and underscoring
need not be included.
SECTION 3. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions
or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable.
SECTION 4. This ordinance shall take effect upon approval.
