MR. INABA: Thank you. It's in your pinkie folders. I brought this up at first
reading, but it's just for internal consistency when it comes to the language. Back
in 2020, the Planning Department, former Planning Director, wrote a letter
granting an administrative extension and instead of granting a specific amount of
time, put a date in there, which is what we currently see in Bill 205. But in
Condition V, we see that an administrative extension could be granted in the
future. So, we just want to make sure that we're referencing time periods rather
than dates. So, if the applicant does need an extension later, we know what
timeframe they would be looking at. So, this actually does grant perhaps a couple
weeks or so longer than September 29, which is currently in the bill. So, we're
not cutting the applicant short of any time. So, I ask for your support. Mahalo.

MS. KIMBALL: Thank you, Chair, and thank you, Aunty Lucille, for being here
today. I only just want to take a moment to celebrate the real heroes here, which
is the community. They lost the gym in Papa`aloa suddenly and unexpectedly,
and they really rallied together to lobby at the State on behalf of our community.
Hundreds of letters. Students putting videos together. It really was just an
incredible example of community engagement. So, they're the real heroes here.
They did bring home that 5 million coming from the State, thanks in large part to
Sylvia Luke as well. So, I want to acknowledge her.
The amendment here to the CIP (Capital Improvement Project)budget is just to
make sure that we can get that 5 million in there, the 5 million County match. As
soon as we've got that in there, we can ask the Governor to release it and we can
start planning on the new gym. So,just asking my colleagues for their support of
the community on this because this was really their work to make it happen.

MR. CHUNG: I wasn't really going to say anything, but first off, I wanted to
congratulate Ms. Kimball for all of her hard work reflective of the community.
But if I could just make one suggestion on this as you guys move forward,
because I have a lot of fond memories of that Papa`aloa Gym, okay. I was still
growing up when that thing was functional.
The last time I went there, there's a lot of potential because it's one of the few
gyms that's right on the coast, yeah. It's right on the cliff. So, there's just so
much potential to have that being a gathering place for people to look at the
ocean,just the expanse of the ocean. So, when you guys are developing the plans,
maybe just keep that in mind. I'm sure you guys have already, but it's just such a
special place. That's all I have to say. Thank you.

Bill 195: AMENDS CHAPTER 7, OF THE HAWAII COUNTY CODE 1983
(Draft 4) (2016 EDITION, AS AMENDED), RELATING TO DISASTER AND
EMERGENCY MANAGEMENT
Changes the title of Chapter 7 from "Civil Defense"to "Disaster and Emergency
Management" and revises and reorganizes the sections therein. Replaces
definitions, inserts sections to clarify Civil Defense Agency organization and
duties, clarifies requirements for Emergency Action Plans and use of multi-
governmental services; and delineates the Mayor's authority to declare a state of
disaster or emergency and ability to exercise emergency powers.

MS. KIERKIEWICZ: Thank you, Chair. It felt so good to say that. It's been a
long road, many months of collaboration with Civil Defense and Corporation
Counsel. Very robust and also important discussions here in chambers at the dais
and with community members on what I think are very substantive but very

necessary changes to Chapter 7 of our Code, written, again, before I was born.
But also in 2014, the State Legislature did update HRS (Hawai`i Revised
Statutes) 127A, prescribing emergency management across the State and the
counties.
It took us a little while but we finally were able to take all of what we have
learned over the number of disasters we've successfully navigated here on
Hawaii Island, and really put together I think an excellent work product that will
help to just clarify and identify the duties and functions of Civil Defense, how we
can be working in partnership with various stakeholders in the community to
prevent, prepare, respond to, and recover from emergencies and disasters, and just
be trigger-ready, a number of plans that are required by the State and Federal
government that are really meant to ensure that our County and our community is
ready for anything that we face, and that also comes with potential funding.
So,just so happy to finally be in this place with all of you, and I just appreciate
again everybody's comments so that we can have the best possible Code language
for our community. I do want to extend my gratitude to Deputy Corporation
Counsel Cody Frenz, Barry, Talmadge, and Bill over at Civil Defense. It's been
an honor and pleasure to work with all of you. I'm excited for us to adopt this
because now we can go to the State Leg. (Legislature) and say, "Okay, we're
ready for funding. We are ready to accept funding that comes with building a
more resilient Hawaii Island community." So,just wanted to turn it over to you
folks for any final words.

Defense Administrative Officer Barry Periatt came forward to address the
members of the Council.)
MR. PERIATT: Good afternoon. I'm Barry Periatt. I'm Administrative Officer
with Civil Defense. Talmadge is meeting with Hawaii Volcano Observatory
right now. I'm sure you've all heard rumors. The volcano is doing unusual
things, but it's not doing anything that would indicate it's going to erupt. I'll be
perfectly clear on that. But it is doing something unusual and that's why there's a
(inaudible). They're approaching it very cautiously.
As far as this bill, it's been said that we have the best Civil Defense Agency in the
world bar none. I heard that in the Mayor's office. The reason Hawaii County
has such a strong Civil Defense organization or emergency management
organization is because so many other departments come together. It's the Police
Department, the Fire Department, your Highways Division at Public Works. It's
your maintenance crews at Parks and Recreation. All these people come together
and provide that manpower to take care of the communities when disaster strikes.
So, it is truly a joint effort by the County.

This bill just helps put in place or puts the requirements in place for us to prepare
the community. It puts the emphasis on preparedness so that, moving forward, we
can hopefully lessen any impacts a disaster would have on us. So, really
appreciate your all support. Thank you very much. A lot of hard work went into
it, and I think we're moving in the correct direction. Thank you.
MS. FRENZ: Good afternoon. Deputy Corporation Counsel Cody Frenz. I'm
here if you have any additional questions. I just thank you for everyone's hard
work to get us to this point.

The County seeks to acquire approximately 26,390 square feet of land to protect
sacred burial grounds, natural resources and buffer zones, and preserve and promote
Hawaiian culture, tradition, and customary practices. This parcel is listed as
priority number 13 for purchase in the 2021 Annual Report of the Public Access,
Open Space, and Natural Resources Preservation Commission.

and her legacy of leadership. Supporting this Leo Club at Konawaena as alumni

volunteers and hundreds of participants recently showed up and celebrated the
25'h anniversary for Higashihara Park. The Leo Club and the Lions Club were
both intrinsically involved in pulling off this successful day. They are really
committed to and participate in all the work being done to refurbish that park.
They've alsoI don't know if any of you have heard them but they have created
radio advertisements and other social media advertisements focusing on soil
depletion and land degradation issues, coupled with solutions and simple things
that any and all of us can do to help mitigate those issues. So, I thank these young
people for their vision, their determination, and their continued dedication to this
important work. I, myself, am incredibly honored and super grateful to be able to
provide funding for their continued work and education of our community for the
ways we can mitigate these challenges, and for that I yield.

more than we anticipated in receiving for this year's Community Development
Block Grant allocation. Normally, what we do is we allocate it to a project that's
high on the list and needed additional funding, which is the Hamakua Youth
Community Center Improvement Phase 1. This is a very much-needed project,
and we wanted to do the appropriation to allocate the funding as quickly as
possible. We have Jeanette, who is the Director of Operations for the Hamakua
Youth here

MR. SHIROMA: Who can explain more.

Increases revenues in the Police Department Private Contributions account
($240,000); and appropriates the same to the Police Department Private
Contributions account. Funds would be used for overtime costs to staff police
officers at traffic points along the 2022 IRONMAN World Championship triathlon
route in Kailua-Kona.

MR. KANEALI`I-KLEINFELDER: I will be supporting this today, but I did kind
of break down the math and talk to some of the folks in the Police Department.
There is some concern that this is not enough funding to cover what will be done,
given that the police officers are no longer considered "special duty." I believe
Ms. Lee Loy spoke to this point at first reading. It was a good point because we
may be very underfunded given the difference in what overtime costs versus what
special duty costs, and the differences in who responds, who shows up for special
duty and who may or may not show up for overtime work. But the event is
tomorrow. So with that,just wanted to put that out there. But I appreciate
everyone's involvement and look for everyone's support.
CHR. DAVID: Thank you, Mr. Kaneali`i-Kleinfelder. Go ahead, Ms. Lee Loy.
MS. LEE LOY: Thank you for that point. It's special duty. It's holdovers;
overtimes; escort rate, which is a whole other animal. And then this event is two
days. So, it will be real interesting to see what comes forward to cover the cost of
