BILLS FOR ORDINANCES Bill 244: INITIATES AN AMENDMENT TO ARTICLE VI, CHAPTER 2, (2020-2022) SECTION 6-2.2 OF THE HAWAI`I COUNTY CHARTER (2020 EDITION), RELATING TO THE DEPARTMENT OF PUBLIC WORKS Replaces the requirement that the Director of Public Works must be a registered professional engineer with the requirement that the Director have a bachelor's Degree in engineering, architecture, public administration or a related discipline, or a degree in law. Adds the requirement that at least two of the five years of required administrative or managerial experience must be in public works or construction, or a related field. AN ORDINANCE TO INITIATE AN AMENDMENT TO ARTICLE VI, CHAPTER 2, SECTION 6-2.2 OF THE HAWAII COUNTY CHARTER(2020 EDITION),RELATING TO THE DEPARTMENT OF PUBLIC WORKS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Article VI, chapter 2, section 6-2.2, of the Hawaii County Charter(2020 Edition) is amended to read as follows: "Section 6-2.2. Director. The director of public works shall be appointed by the mayor, confirmed by the council and may be removed by the mayor. [The director-shall be ., fegistefe professional engineer.] The director shall have had a minimum of five years of experience in an administrative or managerial capacity, two years of which shall have been in a public works, construction or related field. The director shall also have a bachelor's degree in engineering, architecture public administration or a related discipline, or a degree in law." SECTION 2. Charter material to be repealed is bracketed and stricken. New charter material is underscored. When revising, compiling, or printing these charter provisions for inclusion in the Charter of the County of Hawaii, the reviser need not include the brackets, bracketed and stricken material, and underscoring. SECTION 3. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. SECTION 4. Upon adoption of this ordinance,the Council, by appropriate resolution, shall provide that this charter amendment be submitted to the electorate of Hawaii County for approval in the 2024 general election. SECTION 5, The charter amendment proposed in this ordinance shall take effect upon its approval by a majority of voters voting on this legislation in the 2024 general election, as duly certified.
