GIG 22 A RESOLUTION TO AWARD A PUBLIC ACCESS, OPEN SPACE,AND NATURAL SOURCES PRESERVATION MAINTENANCE FUND STEWARDSHIP GRANT T HO`OMALU `U. WHEREAS, Section 10-16 of the Hawaii County Charter establishes a Public Access, Open Space, and Natural Resources Preservation Maintenance Fund(hereinafter"Maintenance Fund") "to preserve the land, promote public safety, and maintain a healthy stewardship"; and WHEREAS, Section 10-16(h) of the Hawaii County Charter provides that the Maintenance Fund may be used for a stewardship grant program for properties purchased via the Public Access, Open Space, and Natural Resources Preservation Fund, which allows 501(c)3 nonprofit organizations to apply for grant-in-aid project funding for stewardship projects; and WHEREAS, Ho`omalu Ka`d is a 501(c)3 nonprofit organization with a stated mission of its project committee, Kahua `Olohd, "to support and guide a community-managed wahi paha of Ka`d based on the cultural, spiritual and educational practices, and protocols of our ancestors"; and WHEREAS, Ho`omalu Ka`d submitted a Maintenance Fund stewardship grant application to continue providing land stewardship and cultural education for the Kahua `Olohd, Kaunamano, Ka`d property,which is situated in in the District of Ka`d (TMK: (3) 9-5-012:005), and acquired via the Public Access, Open Space, and Natural Resources Preservation Fund after adoption of Resolution No. 287-15; and WHEREAS, during its September 12, 2022, meeting and pursuant to Section 2-217 of the Hawaii County Code 1983 (20161 Edition, as amended), the Public Access, Open Space, and Natural Resources Preservation Commission forwarded a positive recommendation for this project to the Director of Finance; and WHEREAS, Communication No. 1077, issued by the Director of Finance on October 14, 2022, submitted for the Council's consideration nine applicants for stewardship grants for various properties that have been acquired by the County using the Public Access, Open Space, and Natural Resources Preservation Fund; and WHEREAS, the Director of Finance in Communication No. 1077 recommends that Ho`omalu Ka`d will be able to complete its project in accordance with the project description submitted and in strict adherence to the conditions governing the Public Access, Open Space, and Natural Resources Preservation Maintenance Fund; and WHEREAS, the Council finds that awarding a stewardship grant to Ho`omalu Ka`u will benefit the community-at-large by demonstrating that maintenance fund monies can be utilized to preserve the land,promote public safety and maintain healthy stewardship of those properties that have been acquired using Public Access, Open Space, and Natural Resources Preservation funding; now,therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that, pursuant to Section 10-16(h) of the Hawai`i County Charter, a Maintenance Fund stewardship grant shall be awarded to Ho`omalu Ka`u in the amount of$26,675. BE IT FURTHER RESOLVED that,pursuant to Section 10-16(g) of the Hawai`i County Charter, funds from the stewardship grant awarded by this resolution shall be used for public safety maintenance and preservation of the Kahua `Olohu, Kaunamano, Ka`u property acquired through the Public Access, Open Space, and Natural Resources Preservation Fund, identified as tax map key (3) 9-5-012:005. BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the Director of Finance. Dated at Kona , Hawai`i,this 16th day of November , 20 22 .
