-40 144 <br /> HAWAIICOUNTY OF * 'trSTATE OF GT <br /> _ 1 <br /> J°°a <br /> 1pE,of•0 <br /> 3 <br /> S <br /> i <br /> SOLUTION NO. 61 22 <br /> A RESOLUTION TO AWARD A PUBLIC ACCESS, OPEN SPACE, AND NATURAL <br /> SOURCES PRESERVATION MAINTENANCE FUND STEWARDSHIP GRANT TO <br /> NA MAMO 0 "WA. <br /> WHEREAS, Section 10-16 of the Hawaii County Charter establishes a Public Access, <br /> Open Space, and Natural Resources Preservation Maintenance Fund(hereinafter"Maintenance <br /> Fund") "to preserve the land, promote public safety, and maintain a healthy stewardship"; and <br /> WHEREAS, Section 10-16(h) of the Hawaii County Charter provides that the <br /> Maintenance Fund may be used for a stewardship grant program for properties purchased via the <br /> Public Access, Open Space, and Natural Resources Preservation Fund, which allows 501(c)3 <br /> nonprofit organizations to apply for grant-in-aid project funding for stewardship projects; and <br /> WHEREAS,Na Mamo O Kdwd is a 501(c)3 nonprofit organization whose mission is to <br /> rehabilitate, curate, and steward the natural and cultural resources of Kdwd to honor the past, <br /> benefit the present, and preserve for the future generations of Ka`u, the Island of Hawaii and all <br /> humankind; and <br /> WHEREAS,Nd Mama O Kdwd submitted a Maintenance Fund stewardship grant <br /> application to continue providing land stewardship and cultural education for the Kdwd Bay <br /> properties,which is situated in the District of Ka`u (TMK: (3) 9-5-016:006 & 025; and (3) 9-5- <br /> 017:005 & 007), and acquired via the Public Access, Open Space, and Natural Resources <br /> Preservation Fund after adoption of Resolution No. 296-07; and <br /> WHEREAS, during its September 12, 2022, meeting and pursuant to Section 2-217 of <br /> the Hawaii County Code 1983 (2016 Edition, as amended),the Public Access, Open Space, and <br /> Natural Resources Preservation Commission forwarded a positive recommendation to the <br /> Department of Finance; and <br /> WHEREAS, Communication No. 1077, issued by the Director of Finance on <br /> October 14, 2022, submitted for the Council's consideration nine applicants for stewardship <br /> grants for various properties that have been acquired by the County using the Public Access, <br /> Open Space, and Natural Resources Preservation Fund; and <br /> WHEREAS, the Director of Finance in Communication No. 1077 recommends that Nd <br /> Mama O Kdwd will be able to complete its project in accordance with the project description <br /> submitted and in strict adherence to the conditions governing the Public Access, Open Space, <br /> and Natural Resources Preservation Maintenance Fund; and <br /> WHEREAS, the Council finds that awarding a stewardship grant to Na Mamo O Kdwa <br /> will allow it to continue its ongoing restoration work on the property, implement a dry land and <br /> coastal rehabilitation plan, and preserve and protect significant cultural features, including a <br /> freshwater spring, loko i`a, heiau, and ahu; and <br />
