SOLUTION NO. 61 22
A RESOLUTION TO AWARD A PUBLIC ACCESS, OPEN SPACE, AND NATURAL
SOURCES PRESERVATION MAINTENANCE FUND STEWARDSHIP GRANT TO
NA MAMO 0 "WA.
WHEREAS, Section 10-16 of the Hawaii County Charter establishes a Public Access,
Open Space, and Natural Resources Preservation Maintenance Fund(hereinafter"Maintenance
Fund") "to preserve the land, promote public safety, and maintain a healthy stewardship"; and
WHEREAS, Section 10-16(h) of the Hawaii County Charter provides that the
Maintenance Fund may be used for a stewardship grant program for properties purchased via the
Public Access, Open Space, and Natural Resources Preservation Fund, which allows 501(c)3
nonprofit organizations to apply for grant-in-aid project funding for stewardship projects; and
WHEREAS,Na Mamo O Kdwd is a 501(c)3 nonprofit organization whose mission is to
rehabilitate, curate, and steward the natural and cultural resources of Kdwd to honor the past,
benefit the present, and preserve for the future generations of Ka`u, the Island of Hawaii and all
humankind; and
WHEREAS,Nd Mama O Kdwd submitted a Maintenance Fund stewardship grant
application to continue providing land stewardship and cultural education for the Kdwd Bay
properties,which is situated in the District of Ka`u (TMK: (3) 9-5-016:006 & 025; and (3) 9-5-
017:005 & 007), and acquired via the Public Access, Open Space, and Natural Resources
Preservation Fund after adoption of Resolution No. 296-07; and
WHEREAS, during its September 12, 2022, meeting and pursuant to Section 2-217 of
the Hawaii County Code 1983 (2016 Edition, as amended),the Public Access, Open Space, and
Natural Resources Preservation Commission forwarded a positive recommendation to the
Department of Finance; and
WHEREAS, Communication No. 1077, issued by the Director of Finance on
October 14, 2022, submitted for the Council's consideration nine applicants for stewardship
grants for various properties that have been acquired by the County using the Public Access,
Open Space, and Natural Resources Preservation Fund; and
WHEREAS, the Director of Finance in Communication No. 1077 recommends that Nd
Mama O Kdwd will be able to complete its project in accordance with the project description
submitted and in strict adherence to the conditions governing the Public Access, Open Space,
and Natural Resources Preservation Maintenance Fund; and
WHEREAS, the Council finds that awarding a stewardship grant to Na Mamo O Kdwa
will allow it to continue its ongoing restoration work on the property, implement a dry land and
coastal rehabilitation plan, and preserve and protect significant cultural features, including a
freshwater spring, loko i`a, heiau, and ahu; and
WHEREAS, this grant will also assist Na Mamo 0 Kawa to work in partnership with
biological and archaeological professionals to execute dryland and coastal rehabilitation, develop
wildlife monitoring protocol, and a.cultural site monitoring plan, while maintaining safe and
secure access to the property,thus satisfying the provisions contained in Section 10-16; and
WHEREAS, the Council further finds that awarding a stewardship grant to Na Mamo 0
Kawa will benefit the community-at-large by demonstrating that maintenance fund monies can
be utilized to preserve the land,promote public safety, and maintain a healthy stewardship of
those properties that have been acquired using Public Access, Open Space, and Natural
Resources Preservation funding; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that,
pursuant to Section 10-16(h) of the Hawai`i County Charter, a Maintenance Fund stewardship
grant shall be awarded to Na Mamo 0 Kawa in the amount of$117,012.48.
BE IT FURTHER RESOLVED that, pursuant to Section 10-16(g) of the Hawai`i
County Charter, funds from the stewardship grant awarded by this resolution shall be used for
public safety maintenance and preservation of Na Mamo 0 Kawa properties acquired through
the Public Access, Open Space, and Natural Resources Preservation Fund, identified as tax map
keys (3) 9-5-016:006 & 025; and(3) 9-5-017:005 & 007.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to the Director of Finance.
