HomeMy WebLinkAboutRES 617 Draft 01 2020-2022A RESOLUTION TO AWARD A PUBLIC ACCESS, OPEN SPACE, AND NATURAL RESOURCES PRESERVATION MAINTENANCE FUND STEWARDSHIP GRANT TO NĀ MAMO O KĀWĀ. WHEREAS, Section 10-16 of the Hawai‘i County Charter establishes a Public Access, Open Space, and Natural Resources Preservation Maintenance Fund (hereinafter “Maintenance Fund”) “to preserve the land, promote public safety, and maintain a healthy stewardship”; and WHEREAS, Section 10-16(h) of the Hawai‘i County Charter provides that the Maintenance Fund may be used for a stewardship grant program for properties purchased via the Public Access, Open Space, and Natural Resources Preservation Fund, which allows 501(c)3 nonprofit organizations to apply for grant-in-aid project funding for stewardship projects; and WHEREAS, Nā Mamo O Kāwā is a 501(c)3 nonprofit organization whose mission is to rehabilitate, curate, and steward the natural and cultural resources of Kāwā to honor the past, benefit the present, and preserve for the future generations of Ka‘ū, the Island of Hawai‘i and all humankind; and WHEREAS, Nā Mamo O Kāwā submitted a Maintenance Fund stewardship grant application to continue providing land stewardship and cultural education for the Kāwā Bay properties, which is situated in the District of Ka‘ū (TMK: (3) 9-5-016:006 & 025; and (3) 9-5-017:005 & 007), and acquired via the Public Access, Open Space, and Natural Resources Preservation Fund after adoption of Resolution No. 296-07; and WHEREAS, during its September 12, 2022, meeting and pursuant to Section 2-217 of the Hawai‘i County Code 1983 (2016 Edition, as amended), the Public Access, Open Space, and Natural Resources Preservation Commission forwarded a positive recommendation to the Department of Finance; and WHEREAS, Communication No. 1077, issued by the Director of Finance on October 14, 2022, submitted for the Council’s consideration nine applicants for stewardship grants for various properties that have been acquired by the County using the Public Access, Open Space, and Natural Resources Preservation Fund; and WHEREAS, the Director of Finance in Communication No. 1077 recommends that Nā Mamo O Kāwā will be able to complete its project in accordance with the project description submitted and in strict adherence to the conditions governing the Public Access, Open Space, and Natural Resources Preservation Maintenance Fund; and WHEREAS, the Council finds that awarding a stewardship grant to Nā Mamo O Kāwā will allow it to continue its ongoing restoration work on the property, implement a dry land and coastal rehabilitation plan, and preserve and protect significant cultural features, including a freshwater spring, loko iʻa, heiau, and ahu; and WHEREAS, this grant will also assist Nā Mamo O Kāwā to work in partnership with biological and archaeological professionals to execute dryland and coastal rehabilitation, develop wildlife monitoring protocol, and a cultural site monitoring plan, while maintaining safe and secure access to the property, thus satisfying the provisions contained in Section 10-16; and WHEREAS, the Council further finds that awarding a stewardship grant to Nā Mamo O Kāwā will benefit the community-at-large by demonstrating that maintenance fund monies can be utilized to preserve the land, promote public safety, and maintain a healthy stewardship of those properties that have been acquired using Public Access, Open Space, and Natural Resources Preservation funding; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that, pursuant to Section 10-16(h) of the Hawai‘i County Charter, a Maintenance Fund stewardship grant shall be awarded to Nā Mamo O Kāwā in the amount of $117,012.48. BE IT FURTHER RESOLVED that, pursuant to Section 10-16(g) of the Hawai‘i County Charter, funds from the stewardship grant awarded by this resolution shall be used for public safety maintenance and preservation of Nā Mamo O Kāwā properties acquired through the Public Access, Open Space, and Natural Resources Preservation Fund, identified as tax map keys (3) 9-5-016:006 & 025; and (3) 9-5-017:005 & 007.
