This was actually waived out of Committee so that we could meet the deadline for the HSAC (Hawai`i State Association of Counties) Executive Committee approval to have these items be considered in the package. So, this is part of the formal process that's outlined in the bylaws by HSAC, which is that each county submits a list of items in bill format or as legislative priorities to be considered by the Executive Committee as part of the package; and then the package will come back to us as a whole thing. So, we'll have a second chance to review all of these. As far as the bills that are being proposed, I wanted to invite Shelly Ogata from District 3's office to speak to the items regarding tobacco and preemption that are on the list of bills. OGATA: Good afternoon, Council Members. My background in public health policy and programming has been called upon to help facilitate this conversation. The counties across our State have many similarities, but there are also a lot of significant differences. Unfortunately, our County has a much higher rate of health disparities. So, bringing back home rule will empower us to make decisions that best fit our needs. By the way, I'm referring to Item No. 2 on the list in that reso. (resolution). Page 3 Hawaii County Council-51 October 19,2022 At this time, I would like to introduce Ms. Peggy Mierzwa—she's the policy director from Hawaii Public Health Institute to explain in a little more detail of how preemption has stripped us of home rule. (Note: At this time, Policy and Advocacy Director Peggy Mierzwa, Hawaii Public Health Institute, came forward to address the members of the Council.) MS. MIERZWA: Aloha. Can everybody hear me okay? MS. KIMBALL: Yes, we can. Thank you. MS. MIERZWA: Great. Thank you. It's a pleasure to be here with you folks. I do have a very short presentation to share with you. I know some folks are a little bit more visual, so I think I can share my screen. Okay, so let's get rolling. Again, my name is Peggy Mierzwa. I am the Policy and Advocacy Director at the Hawaii Public Health Institute. (Note: At this time, Policy and Advocacy Director Peggy Mierzwa, Hawaii Public Health Institute, came forward and provided a PowerPoint presentation to the members of the Council. A copy of the PowerPoint presentation is made a part of the record, see Comm. 1048.1.) MS. MIERZWA: I know that you folks have heard about this already. There are many wonderful advocates in your County discussing this. I know that there was really a great meeting when HSAC met a couple of weeks ago. I'm new at HIPHI (Hawai`i Public Health Institute) so I was unable to be part of that. I just came on about two weeks ago. But I do want to just share with you a little bit about preemption, a little bit about the numbers in our State, and the importance of having the ability to, as a County, make sure we're keeping our communities safe, especially our young. So, if anybody has any questions, I am here for that. Otherwise, thank you so much for your time today. And anything else that you think of after this, reach out to HIPHI. We're happy to help. I know Jahkotta's awesome. She's right there in the County, and she's very passionate about this issue as well. Thank you so much. MS. KIMBALL: Thank you very much for that presentation. Shelly, did you have anything more to add? Okay, great. Thank you. So, yes, that was one of the items as one of the three bills. If you look at the fourth"WHEREAS" clause, we have three bills. Two of them are around preemption. One is a repeal and one of them is a sunset. So, the HSAC Executive Committee would discuss which Page 4 Hawaii County Council-51 October 19,2022 one or whether or not we're going to pursue both. I believe City and County of Honolulu might also have a preemption one coming in through their package. The third bill, which is Item No. 4 on the list, has to do with traffic fines. This is something that we got very close to the finish line last time. What it allows us to do is—well, the State gave themselves the authority to create parking fines that were higher in certain areas as a deterrent. They did not give us that authority on a County road. So, you can imagine the scenario where we have a place that is "no parking,"the fine is minimal, but we have a lot of over-tourism there and it's not a deterrent for parking. So, we would have the authority, by ordinance, to increase the fines in that area if this were to pass here. So, that's the third bill. The resolution that is being proposed has to do with imploring the State Department of Health to adopt rules with regard to the Maui injection well decision. The decision that came from the Supreme Court identifies terms such as "functionally equivalent"with respect to injection wells and kind of leaves it up to the Department of Health to define what"functionally equivalent" is. Since that impacts when a developer or some organization, including ourselves, with respect to wastewater would have to do an NPDES (National Pollutant Discharge Elimination System)permit, we need the Department of Health to move forward with creating some rules around that. So, that's the resolution and that was something the HSAC Executive Committee had discussed as a body, and we're proposing it through our Council. After our conversation about priorities the last time we talked about it, I added some additional priorities although there were no bills submitted on these matters. So, anything related to affordable housing and infrastructure on Department of Hawaiian Home Lands' land, legislation related to workforce development for both civil service and green jobs, wastewater infrastructure and programs to address cesspool conversion, and then, finally, anything that will help us with mental health services and substance abuse services. So, things that are identified and agreed to as legislative priorities mean we just keep an eye out for bills that meet those criteria and then they become part of the package once it's clear that they're moving through the process. So, we don't have to come back to the Executive Committee or the councils to approve that. So, that is what we've had. Just asking for everybody's support on pushing these through up to the HSAC Executive Committee. Thank you. CHR. DAVID: Thank you, Ms. Kimball. Anyone else, Council Members? DAVID: Okay, thank you. Anyone else? Ms. Kierkiewicz, go ahead. MS. KIERKIEWICZ: Thank you, Chair. Mahalo nui, Council Member Kimball, for working so hard to put this package together. Absolutely going to be supporting it. I think it speaks to things that are really important to us as the County, is having a bit more home rule around very specific issues and making sure that we have the ability to address challenges that may be felt a little differently among the other counties. And it just speaks to things that we care about: public health, safety, our community, of the environment. I'm glad to see that the collective priorities that were elevated by this body are in this resolution. When I served on HSAC last term, one of the issues that I always found was during legislative session we were so tied to specific bills that were adopted in our package, we weren't able to advocate for other things that came up during session. We may have similar bills that were elevated by other representative State senators that we were struggling to get the entire Executive Committee to review and approve to submit testimony for. It just wasn't efficient. It wasn't efficient, considering how quickly things move at that level. So, if we identify priorities, I think that gives us or the body, HSAC body, a bit more flexibility in supporting a number of different vehicles throughout the legislative session. So, I'm glad that that's something that's finally taking shape. Again, I'll be supporting this package. Thank you. CHR. DAVID: Thank you, Ms. Kierkiewicz. Anyone else? Ms. Lee Loy, go ahead. MS. LEE LOY: Thank you. Along the same lines, thank you for putting this together. I do really appreciate the nod to our Department of Hawaiian Home Lands in here. We all know that they got$600 million, and their department has put together an idea of how to create housing. One of the concerns that has come up is 600 million sounds like a lot, but infrastructure costs wastewater, roads, water, power those things are really expensive. So, if there are ways for other counties to kind of meet them with some of the infrastructure costs to help the department realize housing and reduce not only the waitlist, but possibly those in homeless or near-homeless situations, would be a wonderful springboard for them. So, thank you for elevating that. As Ms. Kierkiewicz mentioned, the themes are much easier to support, rather than specifics. In the past, and Council Member Chung mentioned, it would be wonderful if we could do minute resolutions for the support of that idea and then later ratify. So, as we step into seating of a new Council, if that was something we could consider where people could sign on as they see fit, rather than going through the process of getting it agendized, which oftentimes takes too long when the bill is just being fast-tracked through the Legislature. KIMBALL: Thank you, both, for your comments, and I just wanted to respond to your comment about the minute resolutions. One of the bills we didn't pass last time was the amendment to the Sunshine Law. We have observed one piece of that, which is allowing testimony in front of the items. The second piece of that was actually to allow the councils to be able to talk to each other for the purpose of formulating testimony. So, we cannot do minute resolutions, but we can without having to wait until Council to talk about testimony on State legislative items as long as we've adopted them as a priority. So, by having done this, we will be able to testify and talk about testimony on the specific items. Thank you. CHR. DAVID: Thank you, Ms. Kimball. Anyone else? Seeing none, I just want to say, Ms. Kimball, thank you for this very comprehensive explanation of our proposal. I think in addition to setting forth what legislation we are going to be that's covered with this resolution, I also really like the options and the priorities that you've provided in this one, and I think it gives us some opportunities that we have not had before in approving these things. Page 7 Hawaii County Council-51 October 19,2022 Bill 207: AMENDS SECTION 25-8-15 (HAMAKUA DISTRICT ZONE MAP), ARTICLE 8, CHAPTER 25 (ZONING) OF THE HAWAII COUNTY CODE 1983 (2016 EDITION, AS AMENDED), BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE-FAMILY RESIDENTIAL— 10,000 SQUARE FEET (RS-10) TO SINGLE-FAMILY RESIDENTIAL— 15,000 SQUARE FEET (RS-15) AT HONOKA`A, HAMAKUA, HAWAII, COVERED BY TAX MAP KEYS: 4-5-010:136 and 4-5-024:010 (Applicant: Lehua Village Partners, LLC) (Area: Approx. 14.322 acres) The Windward Planning Commission forwards its favorable recommendation for this change of zone request, which would allow the applicant to downzone the property to develop a Planned Unit Development by reducing the number of lots in the Lehua Villages from 60 to 40 lots. Lehua Village 1 would consist of 20 lots to be sold at rates pursuant to affordable housing guidelines, and Lehua Village 2 would consist of 20 lots to be sold at market rates. The properties straddle the east and west sides of Lehua Street, north(makai) of the Hawaii Belt Road and south (mauka) of the Honoka`a Park complex, portion of Papa`anui and Haina in Hamakua. This particular project, the rezone request, is tied to a Planned Unit Development that was adopted by the planning commission. So, all those conditions of the PUD (Planned Unit Development) would be adopted if we are to approve this particular bill. Forty lots are going to be created; 20 at affordable rate. I just really appreciate the work that the applicant has done to engage community, in partnership with Council Member for the district, Heather Kimball. I think it's a good project. I will be continuing to support it and do ask my colleagues for their support as well. I do want to note the presence of the applicant and their representatives here. It would create a 15-lot subdivision to support the development of additional housing here on Hawaii Island. The applicant and their representative are here in case folks have additional questions. I also just want to thank the applicant for working with our office and Planning Department to engage the Department of Transportation to deal with some of the traffic concerns that were raised by my colleagues. So, we were able to strengthen that ordinance with additional conditions. So, I'm looking for everyone's continued support on final reading. Thank you. CHR. DAVID: Thank you. Anyone else? Mr. Fuke, you have anything to add to this since you weren't here? (Note: At this time, Planning Consultant Sidney Fuke, applicant's representative, came forward to address the members of the Council.) Page 9 Hawaii County Council-51 October 19,2022 MR. FUKE: Thank you very much, Madam Chair, members of this Council. First of all, thank you very much during first reading to put this out of order because it enabled me to catch an important flight and save my marriage. So, I appreciate it very much. The other thing, too, is we took to heart, as Council Member Kierkiewicz mentioned, took to heart the concerns or the comments made by the public as well as the government agency, particularly Department of Transportation. As a result, it gave birth to Condition E, which the developer, who happens to be here, Mr. John Shaw, will be teaming up with the landowner to do this project. We also took to heart the comments made by the community relative to affordable housing, having the housing geared principally toward the island residents, especially people living in that area. Mr. Shaw is here to, if you want, to publicly make that kind of commitment. But having said that, we believe overall it's a good project and we respectfully request the Council's final approval on this measure. CHR. DAVID: Thank you, Mr. Fuke. Anyone else? Seeing none, before we go on, I just needed to make a note. I've been supporting this for the last couple meetings. And I just needed to make a note that I expressed my desire to talk with some of the surrounding lot owners, and I didn't have a chance until recently. But I was concerned because a testifier that basically represented the fact that the surrounding lot owners, specifically one in particular mentioned in his testimony that it would now allow that family's children to be able to afford a lot and move out of their parents' home. I know those people and I did call, like I said I would, and that was not a true representation of what I heard at the public testimony. Basically, I was informed that, regardless, the cost of that affordable lot would be something out of their reach for their kids. So, to me, that is something I wanted to make note. I will be voting in favor of this again because I really believe that the applicant has made a very sincere effort to address the concerns that we talked about. But I just needed to make that known, that my decision I did follow through and it was not what was represented, and I just wanted to make that point. Because, we do MR. FUKE: Thank you very much for your diligence. CHR. DAVID: Mr. Fuke, we do depend on what is being represented to us. At least I know I do and the people on this body does. And so, I just wanted to make that point. MR. FUKE: We hear you loud and clearly. It's a representation that was not necessarily made by the applicant— CHR. pplicantCHR. DAVID: Yes. Page 10 Hawaii County Council-51 October 19,2022 MR. FUKE: But nonetheless, the applicant would(inaudible) over here but he can just reinforce his commitment. Mr. Cowell is an island-born resident too. And their commitment is really just trying to do a project that addresses the needs of particularly the Kona community. I was just kind of having a conversation with him earlier and the price of the affordable housing lot is kind of dictated by the guidelines that's put forth by the Office of Housing. CHR. DAVID: Understood. MR. FUKE: Regrettably, what it doesn't do is take into account the size of the lots. So, if your affordable lot is, whether it's a 7,500 square foot lot, square foot size, as would be Mr. Meeker's project, or like one-plus acre as in Kate and this situation here, the price is still the same. So, I would think that maybe there should be a sliding scale, but that might be for later (inaudible) CHR. DAVID: Maybe for the next body. MR. FUKE: But maybe that's something that maybe Council Member Inaba and CHR. DAVID: Something that could be considered, yes. But thank you for that, and I just needed to make that. But I will be continuing to support it as I have. I just needed to make that note. MR. FUKE: Thank you very much. CHR. DAVID: Thank you very much. They've had zebras, different apes; and do an outstanding job there. They were ready to pour concrete last weekend and then we had rain. So, I have to admit I'm not unhappy about the rain. I know they were a little disappointed, but they retooled and made it a little fundraiser and sold some food while they had everybody out there. So, I ask for my colleagues' support. They just have been keeping at it. This is right in Kamehameha Park, right on the edge there. It just falls in line with the community's wishes and desires, and they are working hard to get it done.
