A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A MULTI-YEAR LEASE OF REAL PROPERTY FOR THE COUNTY OF HAWAIʻI DEPARTMENT OF
RESEARCH & DEVELOPMENT
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other obligation requiring payment of funds from the appropriations of a later fiscal year or of more
than one fiscal year be approved by resolution; and
WHEREAS, the Department of Research & Development desires to lease approximately 4,686 square feet of office space situated at 88 Kanoelehua Avenue, Suite A-204, in Hilo, County and
State of Hawai‘i, from WKSP Limited Partnership c/o Day-Lum Rentals and Management, Inc. (“Landlord”) to be utilized as the American Job Center Hawai‘i One-Stop-Shop office; and
WHEREAS, the Department of Research & Development desires to enter into a multi-year lease agreement that is anticipated to commence on or about February 1, 2023, for four (4) years
and eleven (11) months, with the option to extend the lease for three (3) additional five (5) year terms with Landlord; and
WHEREAS, the Department of Research & Development is requesting authorization for the Mayor to enter into a multi-year lease agreement with Landlord for office space; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that pursuant to section 10-11 of the Hawai‘i County Charter, the Mayor is hereby authorized to enter into a (4) year and eleven
(11) month lease agreement with three (3) options for extension for the Department of Research & Development as indicated above.
BE IT FURTHER RESOLVED that sufficient funds be budgeted in future fiscal years to cover the anticipated obligations of the County under the terms of the Lease.
BE IT FINALLY RESOLVED that County Clerk shall transmit a copy of this resolution to: (1) Mayor Mitchell D. Roth, (2) Department of Finance and (3) Department of Research & Development.
