HomeMy WebLinkAboutRES 051 Draft 01 2022-2024 tC:X Oi COUNTY OF HAWAII *�� STATE OF HAWAII 3 i RESOLUTION A J A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO NEGOTIATE A SIXTY FIVE-YEAR LEASE WITH THE STATE OF HAWAPI FOR THE PURPOSE OF THE DEVELOPMENT AND CONSTRUCTION OF A PUBLIC LIBRARY BY THE AWAI`I STATE PUBLIC LIBRARY SYSTEM, SITUATED AT WAIOLA, ISTRICT OF SOUTH KOHALA, COUNTY AND STATE OF HAWAII,AND IDENTIFIED AS TAX MAP KEY: (3) 6-8-041:020 AT A SET LEASE RENTAL AMOUNT OF $0.00 PER YEAR. WHEREAS, the County of Hawaii ("County") owns approximately 235 acres of undeveloped property in Waik6loa Village identified as Tax Map Key No.: (3) 6-8-041:002, 003, 004, 005, 006, 007, 008, 009, 010, 011, 012, 013, 014, 015, 016, 019, 020, 021, and 022 for the purposes of providing affordable housing and related purposes at the Kamakoa Nui Subdivision; and WHEREAS, the County intends to develop approximately 1,250 homes within these parcels including land set-aside for the future development and construction of a school and a public library; and WHEREAS,the Waik6loa Village is currently home to over 7,793 residents and 2,810 households who have utilized a bookmobile operated by the non-profit Friends of the Library— Waik6loa Region to promote literacy and community; and WHEREAS,the Friends of the Library—Waik6loa Region has advocated for the development and construction of the Waikoloa Regional Library to serve this growing community for over ten years and the State of Hawaii Public Library System desires to develop and construct, and operate a public library in Waik6loa Village; and WHEREAS,the State of Hawaii, through its Hawaii State Public Library System, desires to lease for gratis TMK No.: (3) 6-8-041:020 containing an area of 2.567 acres, more or less, for a term of sixty-five (65)years within the County's Kamakoa Nui subdivision for the purposes of developing, bulding and operating a public library; and WHEREAS, on August 12, 2022, the Board of Land and Natural Resources authorized the Department of Land and Natural Resources to enter into a ground lease with the County of Hawaii on behalf of the Hawaii State Public Library System for a public library in Waik6loa, South Kohala, Island of Hawaii. WHEREAS, pursuant to Hawaii County Code Article 19, Section 2-120(a)(2), the Hawaii County Council may, by resolution approved by a majority of members, direct the Finance Director to negotiate the disposition of real property by leasing it to governments, governmental agencies, nonprofit organizations, or affordable housing developers. at such rentals and on such terms and conditions as deemed proper; and i I i I i WHEREAS, Hawaii County Code Article 19, section 2-120(b)provides such lease of real property to governments, governmental agencies, nonprofit organizations, or affordable housing developers may be made without the notice or appraisal required in this article; now therefore, E IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAIJ, that pursuant to Hawaii County Code Chapter 2, Article 9, Section 2-120(a)(2) and Hawaii County Code Article 19, section 2-120(b), the Director of Finance is hereby authorized to negotiate a sixty-five year lease with the State of Hawaii for a 2.567 acre parcel on Tax Map Key: (3) 6-8- 041:020 to in Waik6loa Village, County and State of Hawaii at a set lease fee of gratis per the entire term. BE IT FURTHER RESOLVED, that the Mayor of the County of Hawaii is hereby authorized to execute said lease on behalf of the County of Hawaii following its approval by the Council as noted herein. BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the Office of the Mayor, the Department of Finance, the Office of Housing and Community Development, and the State of Hawaii Department of Education Library .
