SUBJECT: Proposed Amendment to Bill No. 12; An Ordinance Amending Section 25-8-6
(Kailua-Honalu Urban Zone Map), Article 8, Chapter 25 (Zoning Code) of the
Hawaii County Code 1983 (2016 Edition, as Amended), by Changing the District
Classification from Agricultural— Five Acres (A-5a)to Family Agricultural—
One Acre (FA-la) at Keauhou,North Kona, Hawaii, Covered by Tax Map Key:
7-7-008:062.
Please see below a proposed amendment to Bill No. 12. The proposed amendment is illustrated
below in Ramseyer format with respect to the contents of Bill No. 12; material to be added is
underscored.
In SECTION 2 of Bill No. 12, Condition M is amended to read as follows:
"M. The Applicant shall be responsible for extending the County sewer system along
P6maika`i Street and installing a connection fronting each proposed parcel, meeting with
the approval of the Department of Environmental Management, and prior to the issuance
of Final Subdivision Approval.
The method of sewage disposal shall meet with the requirements of the State
Department of Health(DOH). DOH will allow the use of an Individual Wastewater
System (IWS), in accordance with Hawaii Administrative Rules (HAR) Title 11
Chapter 62, Wastewater Systems, for the proposed subdivision, provided that each lot is
at least one (1) acre of size or greater and only one (1) dwelling unit with no accessory
dwelling unit(ADU), is constructed on each lot. The proposed subdivided lots and use
of an IWS shall be subject to all applicable provisions of HAR, Title 11, Chapter 62. In
addition, the development project shall connect to the County sewer system should the
lots be developed with more than one dwelling unit on an individual lot."
Due to the limited scope of the amendment, a draft copy of Bill No. 12, in its entirety, that would
result if this proposed amendment is adopted, is not attached.
