Res. 30-23: AUTHORIZES THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAII DEPARTMENT OF THE ATTORNEY GENERAL PURSUANT TO HAWAII REVISED STATUTES SECTION 46-7, FOR A GRANT TO THE OFFICE OF THE PROSECUTING ATTORNEY Allows for the receipt of$75,000, which would be used to cover overtime expenses incurred by multi-agency law enforcement to follow-up on persons ordered by the court to surrender firearms. EVANS: Council Members, any discussion? MS. KIMBALL: Chair, I think we have Deputy Corporation Counsel, Dakota (Cody) Frenz here as well as Director Sako if they need to say anything about these items. No, we're good? Okay, thank you. CHR. EVANS: Actually, may I? Okay, so yes please, I have a question. I think it was important for the community to know how the money was going to be spent because this is such an important issue, firearms in our County. I was looking at your background and justification, and I just felt it was important to state, you know, what this is really about. Would you please, on the justification? (Note: At this time, Deputy Corporation Counsel Dakota(Cody) Frenz came forward to address the members of the Committee.) MS. FRENZ: Good morning, Deputy Corporation Counsel Cody Frenz on behalf of the Prosecutor's Office. I've reviewed the information. So my understanding, and it directly correlates to court orders that are issued, right? So these are, whether they are orders following an arrest that preclude an individual from owning or possessing firearms, maybe it's something directly connected to our Hawaii Revised Statutes (HRS) Chapter 704, which is dealing with individuals that perceivably, or you know, allegedly have mental health issues and they are legally not allowed from a court proceedings to possess firearms. It can be bail conditions, while you know,pending any sort of adjudication or guilt finding, or not-guilty finding, that prohibits you if you're charged with a felony offense or domestic violence offense from possessing. The disconnect comes—we have the court orders, but we don't have enough follow-through, let alone manpower follow-through for the Police Department and/or additional divisions or departments, as it's indicated in the resolution, to assist in the recovery and ensuring the recovery of the firearms that should not be possessed by the person or the individual that has this particular court order or judicial finding, right? If it's a judgement of acquittal, for example, under HRS 704, they also can't possess firearms. So it's a matter of making sure they have the ability to go and get those firearms. And again, keeping in mind, these are legally registered firearms that the Police Department is aware of. That's what these apply to. Page 6 GOEAC-1 January 4,2023 CHR. So, we have Resolution 30-23, authorizing the Mayor to enter into agreement with the State of Hawaii, Department of the Attorney General, pursuant to HRS 46-7, for a grant to the Office of the Prosecuting Attorney. Bill 10: AMENDS ORDINANCE NO. 22-63, AS AMENDED, THE OPERATING BUDGET FOR THE COUNTY OF HAWAII FOR THE FISCAL YEAR ENDING JUNE 30, 2023 Appropriates revenues in the Federal Grants —National Instant Criminal Background Check System Act Record Improvement Program ($75,000); and appropriates the same to the National Instant Criminal Background Check System Act Record Improvement Program account. Funds would be used to cover overtime expenses incurred by multi-agency law enforcement to follow-up on persons ordered by the court to surrender firearms.
