Please consider whether the developer could sue if the County approves this change of zone, then the EnvUnmental
Protection Agency(EPA)imposes a moratorium on extensions of the sewer system until wastewater violations are
corrected.

The Applicant shall be responsible for extending the County sewer system along Pomaika'i Street and installing a
connection fronting each proposed parcel, meeting with the approval of the Department of Environmental
Management, and prior to the issuance of Final Subdivision Approval.

The County is well aware of the risk of an EPA moratorium. Martha's Guzman, EPA Regional Administrator, recently met
with Mayor Roth, and urged a voluntary consent decree for the five County wastewater plants, including Kealakehe,that
are illegally discharging to groundwater. She even offered federal funding through grants that EPA manages--but the
County said no.And private wastewater operators with reuse experience and financing have approached Mayor Roth,
but he has not pursued this option.
