Aloha members of the County Council,
Thank you for this opportunity.
I am writing to express my strong opposition to Bill 12, which proposes the rezoning of 5.292 acres into one-
acre lots (TMK 7-7-008:062). This area is significant and should not be subdivided due to various concerns
related to preservation, catastrophic and emergency preparedness, and over-tourism.
First, the lack of preparedness in the area and the overcapacity issues have already stopped many initiatives in
the past, and it is not advisable to proceed with the subdivision of the land. Additionally, the rules around
archeological preservation are loosened in smaller lots, which is not appropriate for an area with significant
cultural and historical importance.
Furthermore, the developers who have desecrated archeological sites without conducting a proper
Archeological Inventory Survey, (AIS) assessment should not be allowed to subdivide and sell the sacred
grounds of the Native Hawaiians. The area is already struggling with overcapacity and over-tourism, and three
failed attempts at evacuation during tsunamis from 2017 to 2022 highlight the need for caution.
Moreover, the rezoning and permit extension in the area while Kahalu'u Bay is struggling to heal from chemical
and sewage runoff, as well as overcapacity with tourism and the use of chemical sunscreens, is unacceptable.
The cultural and social justice impacts for our Native Hawaiian families are not being upheld by our Hawai'i
State Constitutional law here.
In conclusion, it is of the utmost importance to preserve the agricultural lands in this area and maintain their
current acreage. The developers have not followed a respectful protocol, and I urge the council to stop the
rezoning and subdividing of building permits, and developments in this location. The land is porous and
overused, and the coral reef is dying.
