The State Department of Transportation Motor Vehicle Safety Office has provided the Hawaii County Police Department funding for the Big Island Traffic Safety Awareness Project. This grant is provided to decrease fatal traffic accidents in the South Hilo and Puna districts by at least 5%. This will be accomplished by conducting educational presentations; partnering with the community to do projects; conducting speed enforcement in targeted areas and have monthly public service announcements aired on the radio. Also enclosed is a resolution authorizing the Mayor to enter into an agreement with the State Department of Transportation. Progress reports must be submitted quarterly (ending March, June, September and December) and a final report must be submitted within thirty days of the end of the grant period. Reimbursement claims must be submitted in accordance with the agreement (monthly or quarterly) by the 20th of the month following the claim period. A claim must be submitted even if no expenditures were made. The project is subject to the audit requirements of the Office of Management and Budget (OMB) Circular A-21, Cost Principles for Institutions of Higher Education. Hilo and Puna over a 1-yeaz period through educational presentations/information and the placement of caution signs; (2) To conduct speed enforcement on a monthly basis within the districts of So. Hilo and Puna directed at obtaining compliance to posted speed limits. STRATEGIES: The following strategies will be employed to meet the goals of the project: ? Provide 10 educational presentations dealing with speeding and other traffic - related issues, in partnership with the Big Island Community Coalition for Neighborhood Safety to Neighborhood Watch, Piihonua Houselots Community Association and other interested groups within the districts of So. Hilo and Puna. Note: The following aze two programs that will be utilized. C_TAP: Involves officers providing presentations and the community joining a sign waving project at apre-determined location. C-SAFE: Involves officers returning to the location to conduct enforcement. ? Conduct enforcement efforts comprised of: ? 10 DLII Roadblocks resulting in at least 2 arrest per roadblock. ? 8 SeatbelUChild Restraint Checkpoints resulting in at least 10 SeatbelUS Child Restraint citations per checkpoint. ? 12 Speeding Checkpoints resulting in at least 15 speeding citations per checkpoints conducted. SOLUTIONS: To enable our efforts on this project the following purchases shall be done: ? Purchase 1 portable LCD projector with high illumination capability; 1 notebook computer for use in providing presentations at community meetings. ? Purchase safety equipment for use by community members participating in the C-TAP/Sign Waving projects. ? Purchase 2 Intoxilyzer units for use by the police conducting DUI Roadblocks. ? Purchase 1 Speed Boazd Display w/ hand-held radaz unit to be utilized in selected areas in the community as a speed deterrent and enforcement tool under the C-SAFE project. ? Provide for the travel expenses of 2 individuals to attend a meeting with DOT personnel in Honolulu during July 2000. ? Prepaze and distribute educationaUinformational materials throughout communities to raise awareness regazding traffic-related problems. EVALUATION: Our evaluation of the project shall be based on the following: ? 5% reduction in the number of fatal traffic crashes in the districts of So. Hilo and Puna over a 12 month period. ? Property Agreement A. It is mutually agreed end promised that the APPLICANT shall immediately notify the STATE if any equipment purchaed under this projeU ceases to be used in the roamer u set forth by the projeU agreement. In such event, APPLICANT further agrees to either give credit to the project cost or to another active Highway Safety project for the residual value of such equipment in an amount to be determined by the STATE, or to transfer or otherwise dispose of such equipment u directed by STATE. B. It is mutually agreed and promised by the APPLICANT that no purchased equipment under this projeU will be conveyed, cold, salvaged, tranferred, etc. without the ezproce wrinen approval of the STATE. C. It is mutually agreed a~ promised that the APPLICANT shall maintain or race to be maintainal for its useful life, nay egwpment purchased under this project. III. Application of Hatch Act A. It is mutually agreed end promised that the APPLICANT shall notify all employees of the APPLICANT, whose principal employment is in correction with any Highway Safety project, fmmced in whole or in part by loans or grants under the Highway Safety Act of 1966, of the provision[ of Section ]2 (a) of the Hatch Act (5 U.S.C. 11810 (a)). IV. Equal Opportunity A. It is mutually agreed e~ promised that pursuant to the requirements of Section 22 (e) of the Federal-Aid Highway AU of 1968, Section S04 of the Rehabilitation Ad of 1973 (29 U.S.C. 794), and the Age Discrimination Act of 1975, the APPLICANT, u a condition to receiving approval of this spplicetion submitted under the Highway Safety AU of 1966, hereby gives its usurance that employment in comxtion with Ute eubjed Highway Safety Program project will be provided without regard to race, color, creed, sex, handicap, age, or national origin. The APPLICANT further agrees that, u a condition to receiving approval of this application, it wiB be subject to, end will comply with, Title VI of the Civil Rights Act of 1964, 78 Slat. 252, 42 U.S.C. 2000d to 2000d-0 (hereinafter refemod to u the Act), a~ all applicable requirements pursuant to the Regulations of the Department of Commerce (Title I5, Code of Federal Regulation, Part 8, which have bxa sdopted by the Department of Transportation, and hereinafter referred to u the Regulation), to the e~ that, is accordance with the AU and the Regulations, no person in the United States shall on the ground of rata, color, creed, cez, handicap, age, or natioml origin be excluded from participation in, be denied the benefits of, or be otherwise subjeUed to discrimination under the subject Highway Safety Program or project. B. It is mutually agreed and promised that if the APPLICANT fails or refuses to comply with its undertaking u set forth in these provisions, the STATE of the UNITED STATES DEPARTMENT OF TRANSPORTATION may take any or all of these following action. (I) Cancel, terminate, or suspend in whole or in part the agreement, contraU, or other arrangement with respect to which the failure or refusal occurred; end 12) Refnrin from ezteotling any further Federal financial usistance to the applicant agency under the progrem with respect to which the failure or refusal occurred until satisfactory usurance of furore compliance hu been received from the applicant agency. 2 V. Nonduplication of Grant Fund Ezpendimres A. It is mutually agreed end promised that the APPLICANT has no ongoing or completed projects under agroemwt with any other Federal fund source which duplicate or overlap any work contemplated or descnbad in this project. C. VI. Project Income and Applicable Credits A. It is mutually agreed a~ understood that the APPLICANT shall apply all proceeds or credits generated under the project, such es but not restricted to: The sale of real or personal property royslues received from copyrights snd patents, ante of publications or from personal or incidental cervices, to the projeG in accordance with OMB Circular A-87 (FMC 74-7) or A-21, as applicable and NHTSA/FHWA Order atoanslo.l. VII. Copyrights and Patents , A. It is mutually agreed that any copyrightable materials produced in the course of a projeG may be the property of the State or applicant agency; however, provisions should be made to obtain for the United States Government, the State Governments a~ Iheir political cubdivisioas a royalty-froe nonexclusive, and irrevocable license to use in any roamer each copyrightable material. B. It is mutually agreed that the ownership of all rights accnung from any patentable discoveries or inventions resulting from s project should be covered in the agreement. An irrevocable, nonexclusive, nontransferable, end royalty-free license to praUice each discovery or invention in the manufacture, use and disposition, according to law, of any article or material, and in the use of anX method developed as part of the work user the agreement should be obtained for the United States Government, the State Governments and theca political subdivisions. VIII. Certification Regarding Debarment and Suspension A. Instructions for Certification I. By signing and submitting this proposal, the prospective lower tier participant is providing the certification set out below. 2. The certification in this clause is a material representation of fact upon which reliance was placed when this transaction was entered into. If it is later determined that the prospective lower tier participant knowingly rendered m erroneous certification, is addition to other remakes available to the Faleral government, the department or agency with which this transaction originated may pursue available remedies, including suspension and/or debarment. 3. The prospective lower tier participant shell provide inunediate written notice to the person to which this proposal is submitted if at any lime the prospective lower tier participant learns that its cenifica[ion was erroneous when submittal or has bocome erroneous by reason of changed circumstances. 3 4. The terms covered transaction, 'debarred,' 'suspended,' 'ineligible,' "lower tier covered transacion,' "participant,' "person,' 'primary covered transaction," 'principal,' "proposal," and 'voluntarily excluded,' u used in this clause, have the meanings set out in the Definition and Coverage suctions of 49 CFR Part 29. The prospective lower tier participant agrees by submitting this proposal that, should the proposed covered tnncaUion be entered into, it shall not knowingly enter into any lower tier covered transaction with a person who is debarred, suspeodal, declared ineligble, or voluntarily ezchided from participation in This covered tnasaUion, unless authorized by the department or agency with which this tnutsection originated. 6. The prospective lower tier participant further agrees by submitting this proposal that is it will include this clause titled "Certification Regarding Debarment, Suspension, Inefigbility and Voluntary Exclusion Lower Tier Covered Transaction,' without modification, in all lower tier covered transacions and in all solicitations for lower tier coverod transactions. A participant in a covered transaUion may rely upon a certification of a prospective participant in a lower tier covered traissaaion that it is not debarral, suspended, ineligble, or vohmtarily excluded from the covered transaction, unless it knows that the certification is erroneous. Minority Business Enterprise Requirements It is the policy of the Department of Transportation that minority business enterprises, as defmal in 49 CFR Part 23, shall have the maximum opportunity to participate in the performance of contracts futancecl in whole or in part with Federal funds antler this agreement. Consequently, the MBE requirements of 49 CFR Part 23 apply to this agrcement. ADDENDUM (For MVSO Use Only) SA2 K-08(03-H-O1) The following projects have been approved for funding in FFY 2000: 1) SA2 K-08(02-H-O1), entitled "Big Island Traffic Safety Awareness" for $29,400 and 2) SA2 K-08(03-H-O1), entitled "Piihonua Houselot Community Association" for #2,000. Although this project has been obligated the whole amount, we are limiting the expenditures to only one quarter of the total. We will notify your project when you can expend the entire amount of obligation. Limiting the expenditures to one quarter of the obligation is necessary due to the continuing resolution in the U.S. Congress for highway safety funds. We do not anticipate more than six weeks delay in notification of final obligational funding from Congress. 2.
