A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO NEGOTIATE A SIXTY FIVE-YEAR LEASE WITH THE STATE OF HAWAIʻI FOR THE PURPOSE OF THE DEVELOPMENT AND CONSTRUCTION OF A PUBLIC LIBRARY
BY THE HAWAIʻI STATE PUBLIC LIBRARY SYSTEM, SITUATED AT WAIKŌLOA, DISTRICT OF SOUTH KOHALA, COUNTY AND STATE OF HAWAIʻI, AND IDENTIFIED AS TAX MAP KEY: (3) 6-8-041:020 AT A SET LEASE
RENTAL AMOUNT OF $0.00 PER YEAR.
WHEREAS, the County of Hawaiʻi (“County”) owns approximately 235 acres of undeveloped property in Waikōloa Village identified as Tax Map Key No.: (3) 6-8-041:002, 003, 004, 005, 006,
007, 008, 009, 010, 011, 012, 013, 014, 015, 016, 019, 020, 021, and 022 for the purposes of providing affordable housing and related purposes at the Kamakoa Nui Subdivision; and
WHEREAS, the County intends to develop approximately 1,250 homes within these parcels including land set-aside for the future development and construction of a school and a public library;
and
WHEREAS, the Waikōloa Village is currently home to over 7,793 residents and 2,810 households who have utilized a bookmobile operated by the non-profit Friends of the Library – Waikōloa
Region to promote literacy and community; and
WHEREAS, the Friends of the Library – Waikōloa Region has advocated for the development and construction of the Waikōloa Regional Library to serve this growing community for over ten
years and the State of Hawaiʻi Public Library System desires to develop and construct, and operate a public library in Waikōloa Village; and
WHEREAS, the State of Hawaiʻi, through its Hawaiʻi State Public Library System, desires to lease for gratis TMK No.: (3) 6-8-041:020 containing an area of 2.567 acres, more or less,
for a term of sixty-five (65) years within the County’s Kamakoa Nui subdivision for the purposes of developing, bulding and operating a public library; and
WHEREAS, on August 12, 2022, the Board of Land and Natural Resources authorized the Department of Land and Natural Resources to enter into a ground lease with the County of Hawai‘i
on behalf of the Hawai‘i State Public Library System for a public library in Waikōloa, South Kohala, Island of Hawaiʻi.
WHEREAS, pursuant to Hawai‘i County Code Article 19, Section 2-120(a)(2), the Hawai‘i County Council may, by resolution approved by a majority of members, direct the Finance Director
to negotiate the disposition of real property by leasing it to governments, governmental agencies, nonprofit organizations, or affordable housing developers. at such rentals and on
such terms and conditions as deemed proper; and
WHEREAS, Hawai‘i County Code Article 19, section 2-120(b) provides such lease of real property to governments, governmental agencies, nonprofit organizations, or affordable housing
developers may be made without the notice or appraisal required in this article; now therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I, that pursuant to Hawaiʻi County Code Chapter 2, Article 9, Section 2-120(a)(2) and Hawai‘i County Code Article 19, section 2-120(b),
the Director of Finance is hereby authorized to negotiate a sixty-five year lease with the State of Hawaiʻi for a 2.567 acre parcel on Tax Map Key: (3) 6-8-041:020 to in Waikōloa Village,
County and State of Hawai‘i at a set lease fee of gratis per the entire term.
BE IT FURTHER RESOLVED, that the Mayor of the County of Hawai‘i is hereby authorized to execute said lease on behalf of the County of Hawai‘i following its approval by the Council as
noted herein.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the Office of the Mayor, the Department of Finance, the Office of Housing and Community Development,
and the Hawai‘i State Public Library System.
