HomeMy WebLinkAboutRES 069 Draft 01 2022-2024A RESOLUTION TO AWARD A PUBLIC ACCESS, OPEN SPACE, AND NATURAL RESOURCES PRESERVATION MAINTENANCE FUND STEWARDSHIP GRANT TO PŌHᾹHᾹ I KA LANI.
WHEREAS, Section 10-16 of the Hawai‘i County Charter establishes a Public Access, Open Space, and Natural Resources Preservation Maintenance Fund (hereinafter “Maintenance Fund”) “to
preserve the land, promote public safety, and maintain a healthy stewardship”; and
WHEREAS, Section 10-16(h) of the Hawai‘i County Charter provides that the Maintenance Fund may be used for a stewardship grant program for properties purchased via the Public Access,
Open Space, and Natural Resources Preservation Fund, which allows 501(c)3 nonprofit organizations to apply for grant-in-aid project funding for stewardship projects; and
WHEREAS, Pōhāhā I Ka Lani is a 501(c)3 nonprofit organization whose mission is to revitalize and advance indigenous Hawaiian culture; and
WHEREAS, Pōhāhā I Ka Lani submitted a Maintenance Fund stewardship grant application in 2019 to continue providing land stewardship and cultural education for the Waipi‘o Valley Lookout,
which is situated in the Hāmākua District (TMK: (3) 4-8-004:006), and acquired via the Public Access, Open Space, and Natural Resources Preservation Fund after adoption of Resolution
No. 427-06; and
WHEREAS, during its September 9, 2019 meeting, and pursuant to section 2-217 of the Hawai‘i County Code 1983 (2016 Edition, as amended), the Public Access, Open Space, and Natural Resources
Preservation Commission forwarded a positive recommendation for this project to the Director of Parks and Recreation; and
WHEREAS, Communication No. 267, issued by the Director of Parks and Recreation on May 7, 2021, submitted for the Council’s consideration five applicants for stewardship grants for various
properties that have been acquired by the County using the Public Access, Open Space, and Natural Resources Preservation Fund; and
WHEREAS, Communication No. 267.2, issued by the Director of Parks and Recreation on December 15, 2021, submitted amended budget proposals that revised the original budget proposals by
removing activities that may trigger the need for an Environmental Impact Statement, indirect and incidental costs that would not be covered by the grant award, and activities that
would require governmental permits; and
WHEREAS, the Director of Parks and Recreation in Communication No. 267.2 recommends that Pōhāhā I Ka Lani will be able to complete its project in accordance with the project description
submitted and in strict adherence to the conditions governing the Public Access, Open Space, and Natural Resources Preservation Maintenance Fund; and
WHEREAS, the Council finds that awarding a stewardship grant to Pōhāhā I Ka Lani will allow it to continue its ongoing efforts to reduce invasive species, propagate native plants, educate
users about the area’s history and culture, and preserve the land, promote public safety, and maintain a healthy stewardship; and
WHEREAS, the Council further finds that awarding a stewardship grant to Pōhāhā I Ka Lani will benefit the community-at-large by demonstrating that maintenance fund monies can be utilized
to preserve the land, promote public safety, and maintain a healthy stewardship of those properties that have been acquired using Public Access, Open Space, and Natural Resources Preservation
funding; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that, pursuant to Section 10-16(h) of the Hawai‘i County Charter, a Maintenance Fund stewardship grant shall be awarded to Pōhāhā
I Ka Lani in the amount of $61,056.
BE IT FURTHER RESOLVED that, pursuant to Section 10-16(g) of the Hawai‘i County Charter, funds from the stewardship grant awarded by this resolution shall be used for public safety maintenance
and improvements, preservation of the Waipi‘o Valley Lookout in Hāmākua, and to facilitate educational land stewardship activities on the site acquired through the Public Access, Open
Space, and Natural Resources Preservation Fund, identified as tax map key (3) 4-8-004:006.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the Director of Finance.
