No. 97/Bill No. 24 Your Committee on Legislative Approvals and Acquisitions, to which was referred Bill No. 24, reports as follows: Bill No. 24, transmitted by Mayor Mitchell D. Roth, via Communication No. 97 dated January 19, 2023, amends Section 25-8-33 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning) of the Hawaii County Code 1983 (2016 Edition, as amended), by changing the district classification from Agricultural — three acres (A -3a) to Single -Family Residential — 15,000 square feet (RS -15) at Hilo, South Hilo, Hawaii, covered by Tax Map Key: 2-4-003:035. The subject area is approximately 3.1285 acres, and the applicants are Matthew C. Wung and Eric J. Wung. The Windward Planning Commission forwarded its favorable recommendation for this change of zone request, which would allow the applicant to subdivide the property into five lots ranging in size from 20,080 to 45,363 square feet. The property is located at 862 West Kawailani Street, approximately 1,000 feet west of its intersection with Komohana Street, Waidkea, South Hilo. Thomas Yeh, Esq., representing the applicants, appeared in Hilo Chambers and gave an overview of the project. Mr. Yeh requested a change to Condition H and added that the Department of Public Works had no objection to this request. Council Member Susan L. K. Lee Loy stated that she and Council Member Jenn Kagiwada share the area that this project area sits within, and Ms. Lee Loy offered to work with the applicants to revise this Condition. Council Member Michelle M. Galimba stated that she agrees with the change to Condition H and believes that it would be appropriate for the removal of time limitations for this project. Planning Deputy Director Jeff Darrow was available via zoom and stated that he is amenable to changing Condition H. Council Member Kagiwada voiced concerns regarding existing sewer lines in the area of the project and future plans for expansion, to which Committee Chair Holeka Goro Inaba then requested that the Department of Environmental Management be available at first reading to respond to Ms. Kagiwada's questions.
