RE: BILLS FOR ORDINANCES: AMENDS ORDINANCE NO. 98-91

Aloha
My name is Cindy Freitas and I'm a Native Hawaiian descended of the native inhabitants of Hawai'i
prior to 1778 and born and raised in Hawaii.
I am also a practitioner who still practice the cultural traditional customary practices that was instill in
me by my grandparents at a young age from mauka (MOUNTAIN TO SEA) to makai in many areas.
I OPPOSE AMENDING ORDINANCE NO. 98-91 for the following reasons:
1. The area consist of federally endangered Hawaiian hoary bat, Hawaiian Hawk, akepa and Hawaiian
creeper, `Ope'ape'a, the Hawaiian Goose or Nene, and the `lo above the 3000 foot elevation contour as
"essential habitat". Which falls under the Endanger Species Act.
2. There is no biologist report conducted on the property. There are significant native Hawaiian plant
still exits in the subject property.
3. There is no Floral/Faunal Resources surveys conducted in subject property.
4. There is an Archaeological report done in April 2, 2005 was conducted in the subject property.
However with climate change there is a possibility that expose of historical sight will emerge after 18
years of last report, therefore there the applicant should do another archaeological report.
However State Historical Preservation Division request the opportunity to review future permits for
the subject property. Hawaii Revised Statue 6E-42 Review of proposed projects (Agricultural 20
acres).
(a) Before any agency or officer of the State or its political subdivisions approves any project
involving a permit, license, certificate, land use change, subdivision, or other entitlement for,which
may affect historic property, aviation artifact, or a burial site, the agency or office shall advise the.
department and prior to any approval allow the department an opportunity for review and comment on
the effect of the proposed project on historic properties, aviation artifacts, or burial sites, consistent
with section 6E-43,including those listed in the Hawaii register of historic places.
5. Article 12 section 7 state cultural customary traditional rights are active in this areas. I have been
doing my cultural customary traditional practices by chanting and gathering native plants that
consistent with; palapalai ferns, kupukupu, ho'ele,liko lehua buds and flowers(White, Red and
Yellow) and the fern fine husk used as an antibiotic medicine, and as well as the ko'kolau and the
Mamaki for tea is also antibiotic medicine..

6. This subdivision that this developer whats to do will use 354,851 gallons per acre of land just for
scraper/grader/dozer and must apply water in front of or in conjunction with machines which falls
under the Clean Water Act. Please keep in mind that the subject property is located in the area of the
WATERSHED. And the applicant will have a water runoff into the ground were our aquifer feed is
quite significant.
Therefore this Amends Ordinance No. 98-91 should be OPPOSE. '
