A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO NEGOTIATE A
SIXTY FIVE-YEAR LEASE WITH THE STATE OF HAWAII FOR THE PURPOSE OF
THE DEVELOPMENT AND CONSTRUCTION OF A PUBLIC LIBRARY BY THE
HAWAII STATE PUBLIC LIBRARY SYSTEM, SITUATED AT WAIKOLOA,
DISTRICT OF SOUTH KOHALA, COUNTY AND STATE OF HAWAII,AND
IDENTIFIED AS TAX MAP KEY: (3) 6-8-041:020 AT A SET LEASE RENTAL
AMOUNT OF$0.00 PER YEAR.
Resolution 51-23 would authorize the County of Hawaii to lease 2.567 acres of County-owned
land in Waikoloa, South Kohala,to the State of Hawai`i, Department of Land and Natural
Resources, on behalf of the Hawai`i State Public Library System (HSPLS)for use as a public
library site. The Department of Land and Natural Resources (Department) strongly
supports the adoption of this resolution.
As recited in Resolution 51-23, Waikoloa Village has had a longstanding need for a public
library to serve its community. The State generally endeavors to site State facilities on public
lands under its jurisdiction. However,there are no State lands under the Department's
jurisdiction within reasonable vicinity of WaikOloa Village for a library. The State is grateful to
the County Office of Housing and Community Development for identifying the 2.567-acre site
as a potential location of the public library for the community and appreciates the Council
considering this matter.
Also as recited in Resolution 51-23,the proposed lease is for a term of 65-years on a gratis basis
for the entire term. -The Department believes the rent-free use of the land is appropriate because
the library will serve the residents of Waikoloa Village and the larger Hawai`i County

community. Additionally,the Department notes that the Board of Land and Natural Resources
has made many acres of State lands available for County use on Hawai`i Island for various
public purposes such as government offices and base yards,police stations, fire stations,public
housing facilities, community centers,parks, new County roads,water storage tanks,pumping
stations, and distribution lines, and homeless facilities, and the State does not charge the County
rent or other consideration for the use of these lands.
