RE: BILLS FOR ORDINANCES (FIRST READING) BILL 12 AMENDS SECTION 25-8-6
ARTICLE 8. CHAPTER 25 OF THE HAWAII COUNTY CODE 1983
Aloha,
My name is Cindy Freitas and I'm a Native Hawaiian descended of the native inhabitants of Hawai'i
prior to 1778 and born and raised in Hawai'i.
I am also a practitioner who still practice the cultural traditional customary practices that was instill in
me by mygrandparents at a young age from mauka(MOUNTAIN TO SEA)to makai in many areas.
I OPPOSE Amending Section 25-8-6 Article 8 Chapter 25 for the following reasons:
1. This subdividing is unacceptable due to Kahalu'u Historical District and falls under the Special
Management Area(SMA).
2. The Constitution of the State of Hawai'i clearly states the duty of the State and its agencies is to
preserve, protect, and prevent interference with the traditional and customary rights of the native
Hawaiians. Article XII, Section 7 requires the State to Protect all rights, customarily andtraditionally
exercised for subsistence, cultural and religious purposes and possessed by Ahupua'a tenants who are
descendants of native Hawaiians who inhabited the Hawaiian Islands prior to 1778.
3. The County Council did not read the PD Report which holds very important information. PLEASE

4. Not all family members were notified of their interest.
5. The archaeological reconnaissance in 1985 has a lot of sites and additional features consist of burial
sights there for the AIS should be done before a decision can be made. (due to impact that can cause
irreversibly damages.)HRS 6E
6. There is"NO CLEAR TITLE REPORT" please have the family provided to County Council before a
decision can be made.
Therefore I OPPOSE the Amending of Bill 12.
