I am writing to express my strong opposition to Bill 12. We caught word from neighbors that John Pipan wants to withdrawal permits and the public is unable to access Feb 8 video and testimonies. I find this all too alarming. I do not have the time to dive into the continued questionable acts of how interconnected John Pipan's clients near this location plays a role while we allow rezoning on one family members perspective without allowing the rest of the family to chime in on the future of this land and the legal impact it has because there are no restrictions to this deed. Sincerely, JOHN PIPAN Planning Administrator Land Planning Hawaii LLC Enclosure Copy—Ali'i Development,LLC I do understand that all of our County Council is aware that this area is at overcapacity, and it is not advisable to proceed with the subdivision of the land due to a non restricted deed. Additionally, the rules around archeological preservation are loosened in smaller lots, which is not appropriate for an area with significant cultural and historical importance. Furthermore, the developers who have desecrated archeological sites without conducting a proper Archeological Inventory Survey, (AIS) assessment should not be allowed to subdivide and sell the sacred grounds of the Native Hawaiians. The area is already struggling with overcapacity and over-tourism, and three failed attempts at evacuation during tsunamis from 2017 to 2022 highlight the need for caution. Moreover, the rezoning and permit extension in the area while Kahalu'u Bay is struggling to heal from chemical and sewage runoff, as well as overcapacity with tourism and the use of chemical sunscreens, is unacceptable. The cultural and social justice impacts for our Native Hawaiian families are not being upheld by our Hawai'i State Constitutional law here. In conclusion, I find the longevity of the decisions made will open up opportunities for investors at the highest bid. Thank you for your attention to this matter.
