It seems odd and feels wrong for the court to get into the business of rezoning.
I was unable to stay to hear all of the information provided by different parties, but I left feeling that council members
felt they had no real option other than to approve the rezoning because of the court's"suggestion" (because I don't
think the word "mandate" is the right word in this situation, but, again, I could be wrong).
In any case, there are many critical issues to consider apart from the discomfort and challenges of the family who owns
the land.Those issues affect all of us and will affect future generations.Those cumulative "wrongs", if allowed, would
set yet another precedent of harmful, top-down land use non-planning which plagues our island and, especially, West
Hawaii.
Even with a perfect sewage/wastewater treatment plant, the lack of roadways and other supportive infrastructure are
damning Kailua-Kona residents each day, and with no end in sight. This is why the Kona Community Development Plan
was instituted and made law. Yet who is following that mandate (a legally binding one)? New development and
roadways that aren't pre-planned are kapu. Knowingly damaging natural resources (as per the KCDP but, more
importantly,the State Constitution) is illegal.The shoreline at Kahalu'u is already a seething mass of humanity where
honu can't find a place to Rest In Peace, no less can a human being.Again,the issue — and mandate — is pre-planning
and sticking to it.
There are better ways to solve family issues than to overturn common sense and protections made to help everyone and
the natural resources we all depend upon to thrive and survive. I trust that each of you will search inside and outside of
yourselves to help come up with a better outcome for this property than to go with a flow that would undermine all that
is important and sustaining about Hawaii nei.

Subject: Bill 12 rezoning/subdvision request
Aloha council members,
I believe that the testimony you received and heard from the public regarding a similar rezoning request on Alii Drive is
germane to this request. In particular, the rationale that I provided on behalf of the Sierra Club's Hawaii Island Group is
the same for this parcel as for the Kapukapu proposal in which we focused on lack of suitable, legal, clean, protective
wastewater treatment options.
Our town's wastewater isn't being treated properly or to legal standards. Septic tanks don't do the job, especially so
close to the ocean where this project sits. I'll leave it to the group to provide testimony for this particular project, but
nothing has changed in two weeks, nor do I see it changing in 2 years, sadly.The county doesn't seem interested in
protecting our nearshore waters, and all that they provide us--the basis upon which Hawaii's uniqueness and
abundance are gifts that Hawaii residents and visitors want and need to have conserved to the highest standards
possible.
I also sent testimony that this proposal doesn't conform to the Kona Community Development Plan's tenets,especially
concurrency and, per above, protecting our natural environment and cultural resources.There are no roads or
alternative transportation routes currently on the books for this area — nothing near approval, no less being built.
Again, how long our leaders allow ever-increasing battering of our infrastructure, people and natural resources before
we act preemptively rather than too late. The KCDP requires infrastrature to be in place to support development.
Circumventing that standard circumvents the intent of the KCDP ordinance.The owner of this property might agree.
As I previously testified, I like and admire the applicant. But I stand by the integrity of the KCDP as a way to move
forward to a less highway/car-driven and more community-based land use planning.As far as the wastewater issue, it's
phenomenal that we're discussing further overburdening our precious coastal waters with 1000 cuts.
Please say"NO"to Bill 12 and this rezoning and ask that the applicant return after transportation and environmental
issues are figured out for the area, not just this parcel.
