A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A MULTI-YEAR LEASE OF REAL PROPERTY FOR THE COUNTY OF HAWAIʻI FIRE DEPARTMENT.
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other obligation requiring payment of funds from the appropriations of a later fiscal year or of more
than one fiscal year be approved by resolution; and
WHEREAS, the Hawai‘i Fire Department desires to lease approximately 7,000 square feet of office and warehouse space situated at 1382 Kīlauea Avenue, in Hilo, County and State of Hawai‘i,
from Gerald M. Yamada Trust and Wendy M. Yamada Trust (“Landlord”) to relocate the County of Hawaiʻi Central Fire personnel, apparatus, equipment, and related general services; and
WHEREAS, the Hawai‘i Fire Department desires to enter into a multi-year lease agreement which is anticipated to commence on July 1, 2023, for a five-year term, with the option to renew
the lease for two (2) additional five (5) year terms with Landlord; and
WHEREAS, the Hawai‘i Fire Department is requesting authorization for the Mayor to enter into a multi-year lease agreement with Landlord for this office and warehouse space; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that the Honorable Mitchell Roth, Mayor of the County of Hawai‘i, is hereby authorized to enter into a multi-year lease with Gerald
M. Yamada Trust and Wendy M. Yamada Trust, for a five-year term with options as indicated above.
BE IT FURTHER RESOLVED that sufficient funds be budgeted in future fiscal years to cover the anticipated obligations of the County under the terms of the amended Lease.
BE IT FINALLY RESOLVED that County Clerk shall transmit a copy of this resolution to: (1) Mayor Mitchell Roth; (2) the Department of Finance; (3) the County of Hawaiʻi Fire Department;
(4) the Office of the Corporation Counsel and (5) Gerald M. Yamada Trust and Wendy M. Yamada Trust, 16-212 Melekahiwa Pl., Kea‘au, HI 96749.
