I am-submitting testimony supporting the Hawaii Council's decision to override the mayors veto of bill 194 and require that all zoning extensions be brought to the County Council for a hearing and public review. The council approved the measure by a 6 to 3 majority vote. By vetoing this bill the Mayor fails to acknowledge the will of the majority of voters of this county and their their elected officials. Applicants who receive a change in zoning have an obligation and have made an implicit promise that the change of zoning would create great benefit for the community at the time or reasonably soon after the changes.The extensions are requested because the applicant could not fulfill its original obligations.Things change over time and the public has the right to comment on any possible changes before extensions granted. Zoning extensions should not be under the sole purview of a non elected official absent from public review.
