Your Committee on Legislative Approvals and Acquisitions,to which was referred Bill No. 41 reports
as follows:
Bill No. 41, transmitted by Mayor Mitchell D. Roth, via Communication No. 210, dated March 24,2023,
amends section 25-8-2 (North and South Kona District Zone Map), article 8, chapter 25 (Zoning
Code) of the Hawaii County Code 1983 (2016 edition, as amended), by changing the District
Classification from Agricultural—twenty acres (A-20a)to Agricultural—ten acres (A-1 Oa) at
Kaloko,North Kona, Hawaii, Covered By Tax Map Key: 7-3-027:003
The Leeward Planning Commission forwards its favorable recommendation for this change of zone
request, which would allow the applicants to request subdivision of the property in two 11.3325 acre
lots to accommodate existing single-family dwellings on each lot. The property is located at
73-4375 Haleamau Street, approximately 570 feet northeast of its intersection with Kaloko Drive,
Kaloko Mauka Subdivision,North Kona.
Planning consultant John Pipan and applicant Charles Stevenson were present, as well as Deputy
Planning Director Jeff Darrow.
John Pipan explained that this straight forward request will allow the applicants to simplify an
agreement to each have their own piece of property and will share ninety percent of the land that is
dedicated to native forest, which would help the applicants be excellent stewards of the land.
Mr. Pipan then stated that five years is more than enough time to complete this subdivision.
Deputy Director Jeff Darrow agrees that this is a straightforward rezoning, and that the planning
department supports this request.
Council Member Evans inquired regarding the $15,636 fair share contribution for the additional lot.
Deputy Director Darrow said that the department is working with council's recommendations, and
that contributions to fair share would go toward providing a signalized intersection.
Council Member Heather Kimball stated that the subdivision itself will not trigger cesspool
requirements, but if there are improvements to dwellings, upgrades to the wastewater treatment
systems must be made.

Chair Holeka Goro Inaba stated that he will work with Corporation Counsel for an amendment to
standardized language regarding the time extension language contained in Condition"N".
Your Committee on Legislative Approvals and Acquisitions is in accord with the purpose and intent
of Bill No. 41, and recommends its passage on first reading.
