A RESOLUTION ACCEPTING THE DONATION OF LOTS C,D, E,F AND G OFT E
SUBDIVISION OF PARCEL 2 OF ROYAL PATENT GRANT NUMBER 1895 TO
OHALA, BEING TAX MAP KEYS: (3) 1-3-004:023, :024, :025, :026 AND :027,
SITUATE AT OPIHIKAO, DISTRICT OF PUNA, COUNTY AND STATE OF HAWAII,
FROM JAMES L. KERVER AND MELANY L. KERVER, TRUSTEES UNDER THE
UNRECORDED "JAMES L. AND MELANY L. KERVER REVOCABLE TRUST"

WHEREAS, James L. Kerver and Melany L. Kerver, Trustees under the unrecorded
"James L. and Melany L. Kerver Revocable Trust"dated February 21, 2013 ("Kervers") are the
owners of Lots C, D, E, F and G of the subdivision of Parcel 2 of Royal Patent Grant Number
1895 to Mohala, being Tax Map Keys: (3) 1-3-004:023, :024, :025, :026 and :027, situated at
`Opihikao, District of Puna, County and State of Hawaii, as delineated on Exhibit"A" attached;
and
WHEREAS, the Kervers are desirous of donating the subject parcel to the County of
Hawaii for the purpose of unencumbered open space; and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter,provides that
the Council may accepts gifts, which include the donation of real property, on behalf of the
County of Hawaii; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that in
accordance with Article XIII, Section 13-12 of the Hawaii County Charter,the County of
Hawaii accepts the donation of Lots C, D, E, F and G of the subdivision of Parcel 2 of Royal
Patent Grant Number 1895 to Mohala, being Tax Map Keys: (3) 1-3-004:023, :024, :025, :026
and :027, situate at `Opihikao, District of Puna, County and State of Hawaii, as delineated on
Exhibit "A" attached, for the purpose of unencumbered open space.
BE IT FURTHER RESOLVED that a letter of appreciation be sent to the Kervers
acknowledging their generous donation.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to (1)Mayor Mitchel D. Roth, (2) the Department of Finance, Property Management
Division, and (3) James L. Kerver and Melany L. Kerver, Trustees, P.O. Box 510, Captain Cook,
Hawai`i 96704.
