Re: Multi-Year Agreement with the Department of the Army
Enclosed is a resolution to enter into a multi-year agreement with the Department of the
Army for the Waiakea-Palai Flood Risk Management Project, which provides the
parameters for the design, construction, and maintenance of the Kupulau Ditch Detention
and the Hilo Municipal Golf Detention.
The Department of Public Works requests that this resolution be waived from Finance
Committee and be placed on the May 17, 2023 Council agenda in order to meet funding
deadlines. If there are any questions,please do not hesitate to call Keone Thompson of
the Department of Public Works at 961-8013.

REQUEST FOR COUNCIL ACTION

A. REQUEST:
The Department of Public Works Engineering Division requests a resolution authorizing the Mayor to enter
into an agreement with the Department of the Army for the Waiakea-Palai Flood Risk Management project.
To meet the funding deadline the agreement must be executed by May 19, 2023. Thus, we are requesting to
waive the Finance Committee meeting and be placed on the next Council meeting agenda.
B: BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED:
This agreement is related to design, construction, and maintenance of the Kupulau Detention and Hilo
Municipal Golf Course Detention flood risk management project by the Department of the Army. The
memorandum of agreement is needed for the project to proceed.

RE: Resolution No. 182-23 A RESOLUTION AUTHORIZING THE
MAYOR TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH
THE DEPARTMENT OF THE ARMY REGARDING THE WAIAKEA-PALAI
FLOOD RISK MANAGEMENT PROJECT.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
