RESOLUTION NO. 182 23
A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A
INTERGOVERNMENTAL AGREEMENT WITH THE DEPARTMENT OF
THE ARMY REGARDING THE WALSKEA-PALAI FLOOD RISK
MANAGEMENT PROJECT.
WHEREAS, Hawaii Revised Statutes Section 46-7 requires the County to obtain
consent of the Council to enter into agreements with the federal or state governments respecting
action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive
any funds or other assistance in connection with projects being or to be undertaken pursuant to
those powers; and
WHEREAS,the County of Hawaii Charter, Section 10-11, requires that any contract or
other obligation requiring the payment of funds from the appropriations of a later fiscal year or
of more than one fiscal year shall be approved by resolution; and
WHEREAS,the Department of Public works desires to enter into a Project Partnership
Agreement with the Department of the Army for the Waiakea-Falai Flood Risk Management
Project, which provides the parameters for the design, construction, and maintenance of the
Kupulau Ditch Detention and the Hilo Municipal Golf Detention ("Project"); and
WHEREAS,pursuant to the authority provided in Section 205 of the Flood Control Act
of 1948 (33 U.S.C. 701s) ("Section 205"), the design and construction of the Project was
approved by the Department of the Army by the Division Commander for Pacific Ocean
Division on September 29, 2022; and
WHEREAS, Section 103 of the Water Resources Development Act(WRDA) of 1986, as
amended (33 U.S.C. 2213), specifies the cost-sharing requirements applicable to the Project; and
WHEREAS,total Federal costs associated with planning, design, and construction of a
project pursuant to Section 205 may not exceed $10,000,000 and the County's costs may not
exceed 50% of the construction costs; now,therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII,that in
accordance with Hawaii Revised Statutes Section 46-7 and County of Hawaii Charter, Section
10-11, the Mayor of the County of Hawaii is authorized to execute, on behalf of the County, an
intergovernmental agreement with the Department of the Army for the Waikea-Palai Flood Risk
Management Project.
BE IT FINALLY RESOLVED that the County Clerk of the County of Hawaii shall
transmit copies of this resolution to the Office of Management,the Finance Department, and the
Department of Public Works.
