HomeMy WebLinkAboutBIL 050 Draft 01 2022-2024 AN ORDINANCE AMENDING CHAPTER 14, OF THE HAWAI‘I COUNTY CODE 1983 (2016 EDITION, AS AMENDED), BY ADDING A NEW ARTICLE RELATING TO CONCURRENT INSTALLATION OF ELECTRIC VEHICLE CHARGING STATIONS WITH THE INSTALLATION OF NEW GAS PUMPS AT RETAIL SERVICE STATIONS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I: SECTION 1. Chapter 14, Hawaiʻi County Code 1983 (2016 Edition, as amended), is amended by adding a new article to be appropriately designated and to read as follows: “Article _. Concurrency in Electric Vehicle Charging Installation. Section 14-_. Findings and purpose. Electric vehicles are energy efficient and emit fewer greenhouse gases and air pollutants than traditional gas-powered cars. However, the number of electric vehicle charging stations in the County is inadequate for the existing need. The purpose of this article is to address this deficit by requiring concurrent installation of electric vehicle charging stations when new gas pumps are installed at retail service stations in the County of Hawaiʻi. Section 14-_. Definitions. As used in this article, unless it is apparent from the context that a different meaning is intended: “Retail service station” or “retail station” means a place of business where motor vehicle fuel is sold and delivered into the tanks of motor vehicles and includes a company retail station, a dealer retail station, and an independent retail station. “Alternating current level 2 charging station” means an electric vehicle charging system that utilizes alternating current electricity providing at least six kilowatts per plug and: (1) Is capable of providing electricity from a non-vehicle source to charge the batteries of one or more electric vehicles; (2) Meets recognized standards and protocols including, but not limited to, Society of Automotive Engineers standard SAE J1772 of SAE International and Tesla protocols; and (3) Is designed and installed in compliance with chapter 5D of this Code. Section 14-_. Electric charging concurrency. All retail service stations in the County of Hawaiʻi shall install an equal number of alternating current level 2 charging stations as the number of new gas pumps being installed. This article shall apply when any: (1) New retail service station is established; or (2) Additional gas pumps are installed at an existing retail service station. Section 14-_. Exemptions. Retail service station developments that have already secured construction code permits for new gas pumps shall be exempt from the provisions of this article.” SECTION 2. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. SECTION 3. This ordinance shall take effect upon its approval.
