Your Committee on Legislative Approvals and Acquisitions, to which was referred Resolution
No. 179-23, reports as follows:
Resolution No. 179-23, transmitted by Deanna S. Sako, via Communication No. 294 dated
April 28, 2023, authorizes the Director of Finance to negotiate a sixty-five year lease with the
Housing and Land Enterprise of Hawaii County, dba: Hale O Hawaii for the purposes of
development and construction of a single-family home on Tax Map Key 2-4-024:157 for a pilot
community land trust program at a set lease amount of$10.00 per year.
This resolution would provide a partnership to finance, construct, and sell an affordable home on
state lands, subject to affordability restrictions, to an eligible purchaser for affordable housing and
shelter purposes.
Assistant Housing Administrator Harry Yada and Deputy Corporation Counsel Diane Mellon-
Lacey were available to answer questions about the lease and pilot program, and Mr. Yada
explained that this property was given via executive order from the State of Hawaii.
Several Council Members stated that they want to move this forward and want to hear more about
this from Hale O Hawaii at the next hearing.
Pursuant to Section 2-120(a)(2) of the Hawaii County Code, the council may,by resolution
approved by a majority of its members, direct the finance director to negotiate the disposition of
real property by leasing it to governments, governmental agencies, nonprofit organizations, or
affordable housing developers at such rentals and on such terms and conditions as deemed proper.

Your Committee on Legislative Approvals and Acquisitions is in accord with the purpose and intent
of Resolution No. 179-23, and recommends its adoption.
