Your Committee on Legislative Approvals and Acquisitions, to which was referred Resolution
No. 180-23, reports as follows:
Resolution No. 180-23, transmitted by Finance Director Deanna S. Sako, via Communication

No. 295, dated April 28, 2023, authorizes the acceptance of the donation of lots C, D, E, F, i
and G of the subdivision of parcel 2 of royal patent grant number 1895 to Mohala,being Tax Map
Keys: 1-3-004:023, :024, :025, :026, and :027 situated at O ihikao District of Puna Count
and State of Hawaii, from James L. Kerver and Melany L. Kerver, trustees under the unrecorded
"James L. and Melany L. Kerver Revocable Trust" dated February 21, 2013.
The landowners seek to donate approximately one acre of land to the County for the purpose of
unencumbered open space.
Finance Director Deanna Sako stated that this property is a donation, and in response to inquiry
from Council Member Lee Loy further stated that between now and the next hearing that she will
check with corporation counsel to see if this property could be a PONC (Public Access, Open
Space, and Natural Resources Preservation Commission) donation.
Pursuant to Section 13-12 of the Hawaii County Charter, the council, on behalf of the county, may
accept gifts of donations of money, securities or other personal property or of real estate or any
interest in real estate.
Your Committee on Legislative Approvals and Acquisitions is in accord with the purpose and intent
of Resolution No. 180-23, and recommends its adoption.
