RESOLUTION NO. 1.8S 23
A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL
YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A MULTI-YEAR LEASE OF REAL
PROPERTY FOR THE COUNTY OF HAWAII DEPARTMENT OF ENVIRONMENTAL
MANAGEMENT
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other
obligation requiring payment of funds from the appropriations of a later fiscal year or of more than one
fiscal year be approved by resolution; and
WHEREAS, the Department of Environmental Management desires to lease two units totaling
approximately 14,704 square feet of warehouse space and secured parking situated at 203 Kekuanaoa
Street, in Hilo, County and State of Hawai`i, from Giampaolo Boschetti and Donna-Jean Walden
("Landlord")to be utilized by their Wastewater Division; and
WHEREAS, the Department of Environmental Management desires to enter into a multi-year
lease agreement that is anticipated to commence on or before July 1, 2023, for five (5)years, with the
option to extend the lease for two (2) additional five (5)year terms with Landlord; and
WHEREAS, the Department of Environmental Management is requesting authorization for the
Mayor to enter into a multi-year lease agreement with Landlord for warehouse space and secured
parking; now,therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that pursuant
to section 10-11 of the Hawai`i County Charter, the Mayor is hereby authorized to enter into a five (5)
year lease agreement with two (2) options for extension for the Department of Environmental
Management as indicated above.
BE IT FURTHER RESOLVED that sufficient funds be budgeted in future fiscal years to
cover the anticipated obligations of the County under the terms of the Lease.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution
to: (1) Mayor Mitchell D. Roth, (2)the Department of Environmental Management and(3)the
Department of Finance.
