Your Committee on Legislative Approvals and Acquisitions, to which was referred Resolution
No. 187-23, reports as follows:
Resolution No. 1.87-23, transmitted by Deputy Corporation Counsel Sinclair Salas-Ferguson, via
Communication No. 311, dated May 16, 2023, authorizes the abandonment and sale of a portion of
the Mdmalahoa Highway right-of-way, identified as Remnant R-1, situated at Holualoa.
This resolution seeks to abandon and sell. 215 square foot discontinued right-of-way of Mdmalahoa
Highway at a price established by the finance director that is based on the square foot value used for
determining the real property tax valuations of the abutting owners.
Deputy Corporation Counsel Sinclair Salas-Ferguson explained that there is a 215 square foot
encroachment onto County property and in order for the owner to obtain a permit for improvements
on their home, they sought the approval to purchase it in.order to proceed.
Pursuant.to Section.2-118(b) of the Hawaii County Code, the Council. may allow the finance
director to dispose of remnant real property at a price established by the finance director.
Your Committee on Legislative Approvals and Acquisitions is in accord with the purpose and intent
of Resolution No. 187-23, and recommends its adoption.
