SUBJECT: Proposed Amendments to Bill No. 48, Draft 2; A Bill for an Ordinance to
Amend the Hawaii County Code 1983 (2016 Edition, as Amended), by
Amending Chapter 2, Article 2, Section 2-7; Amending Chapter 2 by Creating
a New Article 49; and Creating a New Chapter 37, relating to Sustainability,
Climate, Equity, and Resilience.
Please see below proposed amendments to Bill No. 48, Draft 2, A Bill for an Ordinance to
Amend the Hawaii County Code 1983 (2016 Edition, as Amended), by Amending Chapter 2,
Article 2, Section 2-7; Amending Chapter 2 by Creating a New Article 49; and Creating a New
Chapter 37, relating to Sustainability, Climate, Equity, and Resilience. The amendments are
illustrated in Ramseyer format with respect to the contents of Bill No. 48, Draft 2; material to be
deleted is bracketed and stricken, and new material is underscored.
SECTION 3 of Bill No. 48, Draft 2 is amended by amending section 37-1-3 (Definitions) by
amending the definitions of"Environmental justice" and"Equity"to read as follows:

fair treatment and meaningful involvement of all people in the development, implementation,
and enforcement of environmental laws, regulations, and policies [, and that the benefits an

""Equity" means [that] the consideration of cumulative impacts on lower- and middle-

making."
Due to the limited scope of these proposed amendments, a copy of the revised draft of this bill
that would result if these amendments are adopted is not attached.
