Cora Aloha: •I'm submitting testimony in support of Bill 48 1_x A BILL FOR AN ORDINANCE TO AMEND THE HAWAII COUNTY CODE 1983(2016 EDITION,AS AMENDED),BY AMENDING CHAPTER 2,ARTICLE 2,SECTION 2-7; r: AMENDING CHAPTER 2 BY CREATING A NEW ARTICLE 49;AND CREATING A NEW CHAPTER 37, RELATING TO SUSTAINABILITY,CLIMATE, EQUITY,AND RESILIENCE. I believe the creation of this chapter will focus the county and its' agencies in decision making on the issues of sustainability, climate,equity and resilience. I would like to offer one amendment to the language specifically in Article 2 Section 37-2-21 (2) referencing"Native Hawaiian guiding principles,tools and frameworks to guide, inform,coordinate, and evaluate proposed actions and solutions". I believe that it is time for the county to be more bold in stating our community's intentions going forward and not be timid about the challenges or underestimate the benefits that changes to the status quo are demanding. Article XII Section 7 of the State Constitution says the following. Section 7. The State reaffirms and shallprotect all rights, customarily and traditionally exercised for subsistence, cultural and religious purposes and possessed by ahupua'a tenants who are descendants of native Hawaiians who inhabited the Hawaiian Islands prior to 1778, subject to the right of the State to regulate such rights. [Add Const Con 1978 and election Nov 7, 1978] Sadly, more attention is needed if we are to truly embrace the values contained in Section 7. It is not enough to generalize its' intention.As a start I would like to suggest an amendment to Article 2 Section 37-2-21(2) of Bill 48 by adding to the last sentence ending" and activities"(ADD)as required under Article XII Section 7 of the Hawaii State Constitution and reaffirmed by the 2000 State Supreme Court's Ka Pa'a Kai 0 Ka Aina decision.
