If this writing is submitted too late, I apologize. I live in the condominium at Richardson
Beach, known as Hale Kahakai. I have lived at two other addresses on Kalanianaole since
2012. Our neighborhood association has been discussing for years the need to decrease
speed, install speed humps or tables on Kalanianaole, and discourage the burning of
rubber.
I am a prosecutor and know how difficult it is to work with the statute known as
"Exhibition of Speed or Acceleration" (HRS 291C-103), or burning rubber. It requires as an
element of proof that is almost impossible, which is that the driver be showing off to
others. I repeatedly bump up against this element in traffic court, because when a citation
is written, I have never seen the names of witnesses provided. I would say that citations for
this offense are given in less than 1% of cases.
We are subjected to the noise and pollution of burning rubber on a daily (mostly at night)
basis. Not only is excessive speed involved, but there seems to be no adequate remedy. I
have called in license plate numbers and chased down offenders, but unless officers are
physically present there is not a lot HPD can do.
I urge you to help eliminate this menace by supporting Councilwoman Lee Loy's Bill
51. Keaukaha is a jewel of a neighborhood, enjoyed by the entire island. We can make it
safer and more enjoyable for everyone by simply lowering the speed limit. Although this
will not address the burning of rubber, it's a great start!
