3N<Y,®f N,ty <br /> COUNTY OF HAWAPI STATE OF HAWAPI <br /> 'rf°Of <br /> RESOLUTIONIST <br /> RESOLUTION AUTHORIZINGINTO AN <br /> AGREEMENT WITH THE UNITEDSTATES T OF <br /> COMMERCE NATIONAL OCEANIC AND ATMOSPHERIC <br /> ADMINISTRATION <br /> WHEREAS, the Civil Defense Agency wishes to enter into a lease <br /> agreement with the,United States Department of Commerce National Oceanic and <br /> Atmospheric Administration ("NOAA"); and <br /> WHEREAS, this agreement is to support NOAA's South Point Weather <br /> Radio Communication network by allowing NOAA to house and maintain their <br /> equipment on a County of Hawai'i ("CON") cell tower located in South Point, <br /> specifically the CON Radio Repeater site identified as WQWD759; and <br /> WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that County <br /> departments obtain the consent of the council to enter into agreements with the <br /> federal or state governments respecting action to be taken pursuant to any of the <br /> powers granted by law to furnish, expend, and receive any funds or other <br /> assistance in connection with projects being or to be undertaken pursuant to those <br /> powers; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in <br /> accordance with section 46-7, Hawaii Revised Statutes, that the Mayor of the <br /> County of Hawaii is authorized to execute, on behalf of the County, an agreement <br /> and related documents with the United States Department of Commerce National <br /> Oceanic and Atmospheric Administration for purpose as described above. <br />
