SUBJECT: Timeframe for Proposed County Charter Amendments
Please be advised that the ballot question and explanation for each proposed Charter Amendment must
be submitted to the Chief Election Officer of the State of Hawaii by August 1, 2024.
Section 11-119 of the Hawai`i Revised Statutes requires that ballot questions be submitted to the State
by August 22, 2024, however Act 115 from the 2023 Legislative Session established a Digital Voter
Information Guide to provide voters with information on candidates and ballot questions. The County of
Hawai`i must submit explanations for each ballot proposal to the State of Hawaii on or before August 1,
2024, to provide sufficient time for translation of the material into several languages.
When considering that date, please factor in the following requirements:
1. A bill proposing an amendment to the Hawai`i County Charter must pass three affirmative
readings at separate regular meetings of the Council before it can be submitted to the Mayor for
his approval. The Charter provides the Mayor 10 business days to act on any bill submitted for
his approval.
2. After any such ordinance is approved by the Mayor, a resolution, which directs the County Clerk
to submit ballot language to the Chief Election Officer of the State of Hawaii,must be adopted
by the Council. (Hawai`i County Charter, Sec.15-2)
3. A ballot question and explanation will need to be developed for each proposal.
Beyond those requirements, there are numerous actions that could impact the course of a proposed
amendment to the Hawaii County Charter, including: postponement, amendment on final reading of the
Council requiring holdover, call for public hearing(s), and mayoral veto.
If deemed warranted,please refer this communication to the appropriate committee for discussion.
