Dear Councilwoman Todd:
Re: Bill 191, Creation of a One-Way Traffic Pattern on Kaniolani Street
You have asked us for an opinion as to who will be responsible for the conditions as set
forth in our road closure permits with the passage of Bill 191.
It is our opinion that the County will absorb al] of the types of duties and responsibilities
that will be associated with the one-way traffic pattern. The traffic division personnel will be
responsible for the creation and installation of the appropriate traffic signs and, in coordination
with the police department, would be responsible for the placement or employment of the signs at
the appropriate times and proper locations, similar to the one-way traffic pattern established on
Waianuenue Avenue or the Sunday only one-way traffic pattern on Kapiolani Street.
Secondly, the County would initially be responsible for the publicizing of the change in the
traffic pattern with its effective dates and times, and also responsible for informing agencies
providing personnel or special duty officers if necessary, and compliance with other County
requirements.
Although the church may agree to accept some of these responsibilities, there is really no
mechanism to enforce their compliance with assuming these responsibilities, other than to repeal
any changes made to the one-way traffic pattern on the dates selected by the church.
