Pursuant to Sections 12-10 and 12-27 of the Hawaii County Code 1983 (2016 Edition, as
Amended), attached is an affidavit attesting that the public hearing and protest procedures were
conducted on the establishment of a Water System Improvement District for Iki Place, Kohanaiki
Homesteads, as proposed by Resolution No. 164-23.

I, Jon Henricks, County Clerk of the County of Hawaii, being first duly sworn on oath, deposes
and says:
1. That pursuant to Sections 12-10 and 12-27 of the Hawaii County Code 1983 (2016
Edition, as Amended), the Hawaii County Council held a public hearing on the
establishment of a Water System Improvement District for Iki Place, Kohanaiki
Homesteads, as propsed by Resolution No. 164-23;
2. That the public hearing convened as scheduled on August 15, 2023, at 5:00 p.m, at the
Kona Council Chambers, West Hawaii Civic Center, 74-5044 Ane Keohokalole
Highway, Building A, Kailua-Kona, Hawaii;
3. That six persons testified, all in support of the proposed improvement district;
4. That the Hawaii County Council, after accepting all public testimony, adjourned the
hearing at 5:19 p.m.; and
5. That no written protests were filed by any owners of an affected assessment unit.
